Is Request to Rezone Approximately <br />6.19 Acres from CL to PD Commercial Retail and Receive <br />Concurrent Planned Development Conceptual Plan Approval <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of October 1, 1996. <br />DESCRIPTION & CONDITIONS: <br />This is a request by Wal-Mart Stores Inc., through its agent Kimley <br />Horn & Associates, Inc., to rezone approximately 6.19 acres of land <br />from CL (Limited Commercial) to PD (Planned Development) Commercial <br />Retail. The subject site is located on the south side of SR 60 <br />immediately east of the existing Wal-Mart store. The subject <br />property lies between SR 60 and the Main Relief Canal and is a <br />remnant grove. The purpose of this request is to secure the proper <br />zoning to expand the existing Wal-Mart store into a superstore. <br />Planning and Zoning Commission Action <br />At its regularly scheduled meeting of August 22, 1996, the Planning <br />and Zoning Commission voted unanimously (5-0) to recommend that the <br />Board of County Commissioners approve the 6.19 acre rezoning from <br />CL (Limited Commercial) to PD (Planned Development). The Planning <br />and Zoning Commission also recommended approval of the conceptual <br />plan with conditions 1, 2, 4, and 6 as proposed in the August 22, <br />1996 Planning and Zoning Commission agenda item. The Planning and <br />Zoning Commission recommended changes to conditions 3, 5, and 7, <br />which relate to traffic impacts on 53rd Avenue, the SR 60 Corridor <br />Plan and fencing around the retention ponds, respectively. Please <br />see pages 24L and 24M of the Planning and Zoning_ Commission minutes <br />for the original staff conditions, and pages 30 and 31 of the <br />minutes for the motion. <br />Subsequent to the Planning and Zoning Commission meeting, planning <br />staff met with traffic engineering division staff regarding <br />condition 3. As a result of that meeting, planning staff has <br />further modified its position on how to address traffic impacts on <br />53rd Avenue and has modified the wording of recommended condition <br />3 (please see item 8 in the report for a full explanation).
