REQUEST FOR MODIFICATIONS TO COUNTY ALCOHOLIC <br />BEVERAGE LICENSE REGULATIONS - LORI FOTHERGILL <br />The Board reviewed the following memo dated 9/25/96: <br />TO: James E. Keating, AICP <br />Community Dove>>lopm nt Dir ctor <br />FROM: Stan Boling, rAZCP <br />Planning Director <br />DATE: September 25, 1996 <br />SUBJECT: Request by Lori Fothergill for the Board of County <br />Commissioners to Modify County Alcoholic Beverage 'License <br />Regulations <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of October 1, 1996. <br />BACKGROUND: <br />Recently, Lori Fothergill, owner, opened The Ultimate Pizza <br />restaurant within the strip shopping center located at 1265 Old <br />Dixie Highway in the newly constructed North South Plaza. After <br />opening her restaurant, Ms. Fothergill applied for a county <br />alcoholic beverage license. Under the county's current alcoholic <br />beverage license procedures, code enforcement staff review all such <br />license applications for compliance with existing zoning <br />requirements and County Code Chapter 300, Alcoholic Beverages, <br />regulations. <br />Current Chapter 300 regulations require the following separation <br />distances: <br />1. Establishments where alcoholic beverages are sold and consumed <br />on -premise must be at least 1,000' from the nearest church or <br />school. <br />2. Establishments where alcoholic beverages are sold and consumed <br />off -premise must be at least 500' from the nearest church or <br />school. <br />During its review of Ms. Fothergill's license, code enforcement <br />staff determined that The Ultimate Pizza is 668' from the nearest <br />church (the "Primitive Baptist Church" located at the northeast <br />corner of Old Dixie Highway and 12th Street and which is zoned <br />commercial). Thus, the restaurant location satisfies the 500' but <br />not the 1,000' separation distance criterion. Therefore, staff <br />issued an alcoholic beverage license allowing on -premise sales but <br />not on-site consumption of alcoholic beverages. <br />Ms. Fothergill has requested that the Board grant a variance or <br />change the county code to allow on -premise consumption of alcoholic <br />beverages at the present site of The Ultimate Pizza. <br />63 <br />OCTOBER 1, 1996 r LL LL ��j(�11 <br />BOOK <br />
