ARTICLE 25 <br /> SEPARATIONS <br /> 25.1 The effective date of separation shall be the last day on which the employee is <br /> present for duty unless otherwise specified herein. <br /> 25.2 Resignation is defined as an action whereby an employee voluntarily leaves <br /> County employment. An employee wishing to leave the County in good standing <br /> shall file with the County a written resignation, stating the date and reasons for <br /> leaving. Such notice must be given at least two weeks prior to the date of <br /> separation. Failure to comply with this courtesy may be cause for denying such <br /> employee re-employment with the County. Employees who are absent from <br /> work for three consecutive work days without providing proper notice and being <br /> excused (unless the employee is physically unable to provide notice) will be <br /> considered as having "abandoned their position" and thereby voluntarily quit. <br /> Requests for vacation leave shall not be unreasonably denied in accordance with <br /> Article 31.6. At that time, the County will formally note the termination and advise <br /> the employee and the Union of the action by first class U.S. mail to the <br /> employee's address on record in the Human Resources Department. <br /> 25.3 Retirement is defined as a voluntary or involuntary procedure whereby an <br /> employee separates from County employment for reasons of length of service or <br /> disability. Retirement regulations and benefits shall conform with the provisions <br /> of the Florida Retirement System. <br /> 25.4 Termination shall be effective as of the date of death. All compensation and <br /> benefits due to the employee as of the effective date of separation shall be paid <br /> to the beneficiary, surviving spouse, or the estate of the employee, as <br /> determined by law or by executed forms in the employee's personnel file. <br /> 25.5 If a layoff does occur the County will determine which classifications within the <br /> affected division will be eliminated. For purposes of this section, "classification" <br /> shall be defined as the established positions in the bargaining unit's pay plan. <br /> Additionally, full-time and part-time positions shall be considered separate <br /> classifications. For purposes of this section, "division" shall be defined as <br /> follows: Aquatic Centers, Customer Service, Engineering, Facilities <br /> Management, Fire Rescue, Golf Course, Ocean Rescue, Parks, Road and <br /> Bridge, Sanitary Landfill, Traffic Engineering, Vehicle Maintenance, Wastewater <br /> Collection, Wastewater Treatment, Water Distribution, Water Production. The <br /> employees in the affected classification within the affected division shall be laid <br /> off based on the inverse order of their county-wide seniority (most recent hire <br /> date). In lieu of layoff, an affected employee may displace any less senior <br /> employee in the bargaining unit in any lower classification providing he/she <br /> previously held the position and remains qualified. Employees accepting <br /> positions in a lower classification will receive a 5% reduction per pay grade; <br /> however, the newly established pay shall not exceed the maximum of the new <br /> pay grade.
