American Land Title Association Owner's Policy of Title Insurance <br />2021 v. 01.00 (07-01-2021) <br />WESTCOR with Florida modifications <br />SCHEDULE <br />Policy Number: OP-61-FL1394-16966388 <br />EXCEPTIONS FROM COVERAGE <br />Some historical land records contain Discriminatory Covenants that are illegal and unenforceable by law. <br />This policy treats any Discriminatory Covenant in a document referenced in Schedule B as if each <br />Discriminatory Covenant is redacted, repudiated, removed, and not republished or recirculated. Only the <br />remaining provisions of the document are excepted from coverage. <br />This policy does not insure against loss or damage and the Company will not pay costs, attorneys' fees, or <br />expenses resulting from the terms and conditions of any lease or easement identified in Schedule A, and the <br />following matters: <br />1. Rights or claims of parties in possession not shown by the Public Records. <br />2. Any encroachment, encumbrance, violation, variation, or adverse circumstance affecting the Title that would <br />be disclosed by an accurate and complete survey of the Land. The term "encroachment" includes <br />encroachments of existing improvements located on the Land onto adjoining land, and encroachments on <br />the Land of existing improvements located on the adjoined land. <br />3. Easements or claims of easements not shown by the Public Records. <br />4. Taxes or special assessments which are not shown as existing liens by the public records. <br />5. Taxes and assessments for the year 2026 and subsequent years, which are not yet due and payable. <br />6. This policy does not insure a right of access to and from the lands insured hereby, notwithstanding any <br />insuring provision contained elsewhere in this policy. <br />7. Easement recorded in Official Records Book 1406, Page 2689, of the Public Records of Indian River <br />County, Florida. <br />8. Any lien provided by Chapter 159, Florida Statutes, in favor of any city, town, village or port authority for <br />unpaid service charges for service by any water, sewer or gas system supplying the insured land. <br />9. Riparian rights and littoral rights, if any, incident to the land. <br />10. Title to any portion of the land lying below the ordinary high water mark of unnamed Lake, unaffected by <br />fills, man-made jetties and bulkheads. <br />11.
