FIRST AMENDMENT TO THE AGREEMENT FOR LANDFILL GAS FLARE STATION This FIRST AMENDMENT to that certain Agreement for Landfill Gas Flare Station is entered into effect as of September 24, 2024, by and between INDIAN RIVER COUNTY, a Political Subdivision of the State of Florida organized and existing under the Laws of the State of Florida, (hereinafter called OWNER) and SCS Field Services (hereinafter called CONTRACTOR). OWNER and CONTRACTOR, in consideration of the mutual covenants hereinafter set forth, agree as follows: BACKGROUND RECITALS WHEREAS, OWNER and CONTRACTOR entered into an agreement for services relating to Landfill Gas Flare Station, effective July 2, 2024; and, WHEREAS, the parties wish to modify the Work to include services defined and priced in accordance with the proposals provided Exhibit i to this amendment. NOW, THEREFORE, in consideration of the foregoing, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the OWNER and CONSULTANT agree as follows: 1. The background recitals are true and correct, and form a material part of this First Amendment. 2. The services detailed in Exhibit 1 to this First Amendment are hereby added to the Work under the agreement. 3.
