Fr— <br />Bau 93 f'A3 355 <br />storage tanks at 170 Filbert Street and 810 Bailey Drive, <br />Sebastian, by Florida Waste Environmental Services, Inc. <br />Attached is the proposed agreement setting forth the conditions and <br />scope of services to be provided. <br />RECOMMENDATION <br />The staff of the Department of Utility Services recommends that the <br />Board of County Commissioners approve and execute the attached <br />contract as presented. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously approved <br />the Agreement with Florida Waste Environmental <br />Service, Inc., as recommended by staff. <br />AGREEMENT IS ON FILE IN THE OFFICE OF THE <br />CLERK TO THE BOARD <br />L. Willow Street - Repeal of Special Assessment Project and Release of <br />Related Liens <br />The Board reviewed a Memorandum of October 2, 1996: <br />TO: BOARD OF COUNTY COMMISSIONERS DATE: October 2, 1996 <br />� A. <br />FROM: Lea R. Keller, CLA, County Attorney's Office <br />THRU: Charles P. Vitunac, County Attorney <br />RE: Repeal of Willow Street Special Assessment <br />Project and Release of Related Liens <br />The Board of County Commissioners at its meeting October 1, 1996, <br />approved the County entering into a settlement of a lawsuit on the <br />Willow Street special assessment paving and drainage project, which was <br />filed against the County by an affected property owner. <br />The attached resolution repeals the assessment project, releases all <br />liens, and directs any escrowed funds to be returned. <br />REQUESTED ACTION: Board authorize the Chairman to sign the <br />attached Resolution. <br />County Attorney Vitunac advised the funds will be held in <br />escrow until all legal documents are completed and all releases <br />received from the appropriate parties. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously adopted <br />Resolution 96-126 cancelling Resolution No. 95-103, _ <br />which previously approved and confirmed a special <br />assessment project for the paving and drainage of <br />Willow Street from _CR -512 south to 77th Street and <br />releasing all liens. <br />OCTOBER S, 1996 26 <br />
