Revise <br />Revise: Through 2040, there will strive for no reduction in flood storage <br />capacity or the other natural functions and values of floodplains in <br />Indian River County. <br />Policy 4.1: <br />Consistent with Policy 5.1 of the Stormwater Management Sub-element, the county shall regulate development in areas <br />designated as regulatory on FEMA' s most current Flood Insurance Rate Maps (FIRMs). Within designated regulatory <br />floodways, all encroachment shall be prohibited, including: fill, new construction, substantial improvements, and other <br />development within the adopted regulatory flood that would result in any increase in flood levels within the county <br />during the occurrence of the base flood discharge. <br />No Change <br />Policy 4.2: The county shall continue to regulate development within flood prone areas to minimize flood storage capacity <br />reduction and to afford protection to life and property within floodplains. No Change <br />Policy 5.2: <br />Indian River County shall require the restoration and management of wetlands as mitigation for the limited filling of <br />degraded wetlands, provided that the following criteria, as defined in LDR Chapter 928, are met: <br /> ~ The benefits of the restoration and management of natural functions shall offset the losses of wetland functions <br />associated with the limited wetland filling; <br /> ~ A conservation easement shall be established to ensure protection; in addition, Indian River Mosquito Control <br />District (IRMCD) will be granted access easements to allow for mosquito inspection, treatment, and management; and <br /> ~ The restoration and management plan shall be consistent the Uniform Mitigation Assessment Method (UMAM) <br />utilized by FDEP and SJRWMD, and with U.S. Army Corps of Engineers regulations, as defined in Section 404 of the Clean <br />Water Act. <br />Revise <br />Revise: Indian River County shall require the restoration and <br />management of wetlands as mitigation for the limited filling of <br />degraded wetlands, provided that the criteria, as defined in LDR Chapter <br />928, are met and FDEP and/or SJRWMD regulations are met. <br />Policy 5.3: Indian River County shall require a buffer zone of native upland edge vegetation to be retained around wetland and <br />open water habitats which are constructed or preserved on new development sites. Consistent with Future Land Use Policy 1.31, the specific boundaries of estuarine wetlands and the <br />C-2 designation shall be determined on a site-by-site wetland survey basis. <br />Revise <br />Revise to the following: In recognition of the many natural functions and <br />values of estuarine wetlands, and in recognition of the need to protect <br />these resources from incompatible land uses for the sake of the public <br />interest, the environmentally sensitive estuarine wetlands are <br />designated C-2 within the Conservation District, on the comprehensive <br />plan future land use map.
