<br /> <br /> <br />PAGE 113 <br /> <br />GOP Number GOP Language Recommended Action Comments/Rationale <br />MPP, and if the powerboat to shoreline restriction on the existing facility has been in place prior to July 1993, when the <br />countywide speed zone rule was posted. <br />Policy 3.3: <br />The following boat ramp siting criteria shall be used to evaluate any new boat ramp or the rearrangement or expansion <br />of an existing boat ramp. These criteria shall be applied to all boat ramps (e.g., new, existing, private, public, <br />commercial, recreational, multi-family, or individual single-family). <br />1. The rearrangement of existing boat ramps shall not be subject to the boat ramp siting criteria unless any one of the <br />following are true: <br />a. The rearrangement will result in more lanes than currently exist (i.e., expansion); <br />b. The rearrangement will result in the boat ramp being able to increase the volume of traffic (e.g., increase the <br />number of parking spaces, make the boat ramp more accessible, deepen or widen the access channel); <br />c. The rearrangement will result in the boat ramp being able to be used by larger vessels (e.g., increase the size of the <br />parking spaces, deepen or widen the access channel); or <br />d. The rearrangement or the associated construction will destroy, alter, or disturb any native upland, shoreline <br />vegetation, or SAV. <br />2. The siting of new or the rearrangement or expansion of existing boat ramps shall be prohibited in the following <br />areas of Indian River County: <br /> • All of the St. Sebastian River west of the U.S. 1 Bridge; <br /> • All of the Pelican Island National Wildlife Refuge; <br /> • The area known as Jungle Trail Narrows; <br /> • Town Limits of Orchid; <br /> • Town Limits of Indian River Shores; <br /> • If the proposed site is within a High Manatee Use area AND a High Watercraft-related Manatee Mortality area, as <br />defined in this MPP. <br />3. The siting of new or the rearrangement or expansion of existing boat ramps shall be prohibited when one or more <br />of the following conditions are met: <br />a. The footprint of the new boat ramp or the rearrangement or expansion of the existing boat ramp (including all <br />proposed lanes, docks, access walkways, finger piers, mooring areas, turning basins, and ingress and egress pathways) <br />has a SAV coverage of ten (10) percent or greater using a scientifically acceptable method of coverage determination <br />and such determination is made between the months of May through October; <br />b. The site, whether new or existing, is located within a High Manatee Use area, AND a High Watercraft-related <br />Manatee Mortality area as defined in the MPP; or <br />c. The site, whether new or existing, is located such that new dredging will be required or necessary to provide access <br />to the ICW or to deeper water AND the site is located within or on land adjacent to a FDEP designated Aquatic <br />Preserve. This does not include manmade waterbodies such as canals or basins, or privately owned submerged <br />bottom. <br />In the event that all the required or necessary dredging is determined by the FDEP or the SJRWMD to be maintenance <br />dredging, then this subsection [3(c)] does not apply. The determination of maintenance dredging shall be made in <br />writing by the FDEP or SJRWMD <br />and submitted to County Planning staff. It is the responsibility of the applicant, the property owner, or developer to <br />secure this written documentation. If any of the required or necessary dredging is determined to not be maintenance <br />dredging (i.e., new dredging) then that part of the proposed project involving the proposed new dredging and any <br />other activity or structures associated with the proposed new dredging, is prohibited. <br />Consolidate/Remove Consolidate with Policy 3.2 or remove from Plan and adopt by <br />ordinance into the LDRs.
