Board of County Commissioners Meeting Minutes - Final <br />10.A.3. 24-0649 <br />August 20, 2024 <br />There being no further comments, the Chairman closed the public hearing. <br />A motion was made by Commissioner Loar, seconded by Vice Chairman <br />Flescher, to approve staffs recommendation and adopt Ordinance 2024-009, <br />amending the Zoning Ordinance and the accompanying Zoning Map for <br />approximately ±1.45 acres located on the west side of Highway US 1, .17 of a <br />mile south of 53rd Street, north of 49th Street, on the east side of Old Dixie <br />Highway, from IL, Light Industrial to CG, General Commercial, and providing <br />codification, severability, and effective date. The motion carried by the <br />following vote: <br />Aye: 5 - Chairman Adams, Vice Chairman Flescher, Commissioner Earman, <br />Commissioner Moss, and Commissioner Loar <br />Jonathan D. Barkett's Request for Abandonment of a 25' Wide Platted <br />Right -of -Way [ROW -24-05-02 / 99070136-96169] (LEGISLATIVE) <br />Recommended Action: Staff recommends that the Board of County Commissioners abandon its rights to <br />the subject portion of right-of-way, and authorize the chairman to execute the <br />proposed abandonment resolution. <br />Attachments: Staff Report <br />Location Map <br />Resolution <br />Chief of Current Development Brandon Creagan presented the request to <br />abandon the right-of-way (ROW) at 19th Court. Mr. Creagan infonned that the <br />request had been reviewed and approved internally, no easement was needed, <br />and the property was not needed for County roadway access. <br />The Chairman opened the public hearing. There being no comments, the <br />Chairman closed the public hearing. <br />A motion was made by Commissioner Earman, seconded by Vice Chairman <br />Flescher, to approve staffs recommendation and Resolution 2024-042, <br />providing for the closing, abandonment, vacation and discontinuance of the <br />[entirety] of a 25' wide unimproved, right-of-way known as 19th Court, east of <br />the Jackson Brothers subdivision and south of 41st Street in the Jackson <br />Brothers subdivision located in Indian River County, Florida.
