ORDINANCE NO. 2024-010 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, AMENDING INDIAN RIVER <br />COUNTY CODE CHAPTER 102, SECTION 102.01 "BOARD OF <br />COUNTY COMMISSIONERS MEETINGS AND PROCEDURES" TO <br />MODIFY THE BOARD MEETING TIMES AND AMENDING SECTION <br />102.04 "ORDER OF BUSINESS", TO ADD NEW "DEPARTMENTAL <br />MATTERS" AND TO MODIFY PUBLIC COMMENT PROCEDURES. <br />WHEREAS, Chapter 102 of the Indian River Code has been adopted to govern the <br />meetings and procedures of the Board of County Commissioners; and <br />WHEREAS, to allow for more flexibility in its meeting times, the Board would like to <br />modify the Code to allow for meetings to occur on the last Tuesday of the month; and <br />WHEREAS, the Board desires to update its order of business to add consideration of <br />matters from the newly created Building and Facilities Services department; and <br />WHEREAS, to provide more uniformity and consistency in its public comment <br />procedures, the Board would like to modify its order of business to create two categories for <br />public comment — one for agenda related items before County business and one for non - <br />agenda items at the end of the meeting. <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA THAT: <br />Section 1. Enactment Authority. <br />Article VIII, section 1 of the Florida Constitution and chapter 125, Florida Statutes vest broad <br />home rule powers in counties to enact ordinances, not inconsistent with general or special <br />law, for the purpose of protecting the public health, safety and welfare of the residents of the <br />county. The Indian River County Board of County Commissioners specifically determines <br />that the enactment of this ordinance is necessary to protect the health, safety and welfare <br />of the residents of Indian River County. <br />Section 2. Code Amendments. <br />Indian River County Code Chapter 102, Section 102.01(1), Board of County <br />Commissioners Meetings and Procedures, is hereby amended to read as follows: <br />CODING: Words in st6ke-fl44:eugh format are deletions to existing text; words in underlined format are <br />additions to existing text. <br />
