Titkanich, Jr., County Administrator <br />FROM: Zac Portwood, Acting Director of Information Technology <br />SUBJECT: New Cingular Cell Radio Lease for King's Highway <br />BACKGROUND <br />In March 2004, the Board of County Commissioners entered into a lease <br />agreement with Bellsouth Mobility, dba Cingular Wireless (now known as New <br />Cingular Wireless, and owned by AT&T). The Agreement allowed New Cingular <br />Wireless to install and operate a communications facility at Kings Highway <br />Elevated Water Tank. On September 10, 2013, and again on October 15, 2015, <br />and a third time on November 15, 2016, this License Agreement was Reinstated, <br />Ratified, and Amended. This Agreement expired on March 28, 2024. New <br />Cingular Wireless, in mutual interest with Indian River County, wish to Reinstate <br />this agreement and make a Fourth Amendment. <br />FUNDING <br />There is no cost to the county as a result of this lease. New Cingular Wireless will <br />pay One Million Twenty -Eight Thousand Five Hundred Thirteen and 00/100 <br />Dollars ($1,028,513.00), in monthly increments of Seven Thousand Dollars <br />($7,000.00) over a period of ten (10) years.
