ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously approved <br />staff's recommendation and allocated $76,389.16 from <br />the Petition Paving Account #111-214-541-035.39 and <br />adopted Resolutions 96-128 and 96-129 providing for <br />paving and drainage improvements and setting public <br />hearing date for 6th Lane, 40th Avenue SW and Deuce <br />Court in West Side Subdivision. <br />Providing (First Reso.) <br />RESOLUTION NO. 96-128 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR <br />CERTAIN PAVING AND DRAINAGE IMPROVEMENTS TO 6TH <br />LANE, 40TH AVENUE SW (SOUTH OF 5TH STREET SW) AND <br />DEUCE COURT LOCATED IN THE WEST SIDE SUBDIVISION, <br />PROVIDING THE TOTAL ESTIMATED COST, METHOD OF <br />PAYMENT OF ASSESSMENTS, NUMBER OF ANNUAL <br />INSTALLMENTS, AND LEGAL DESCRIPTION OF THE AREA <br />SPECIFICALLY BENEFITED. <br />WHEREAS, the County Public Works Department has been <br />petitioned for Road Paving and Drainage Improvement for 6th Lane, <br />40th Avenue SW (South of 5th Street SW) and Deuce Court located in <br />West Side Subdivision. <br />WHEREAS, the construction of paving and drainage <br />improvements by special assessment funding is authorized by Chapter <br />206, Section 206.01 through 206.09, Indian River County Code; and <br />cost estimates and preliminary assessment rolls have been completed <br />by the Public Works Department; and the total estimated cost of the <br />proposed paving and drainage improvements is SEVENTY-SIX THOUSAND, <br />THREE HUNDRED EIGHTY-NINE DOLLARS and SIXTEEN CENTS ($76,389.16); <br />and <br />WHEREAS, the special assessment provided hereunder shall, <br />for any given record owner of property within the area specially <br />benefited, be in an amount equal to that proportion of one hundred <br />percent (1000) of the total cost of the project ($76,389.16) which <br />the number of parcels owned by the given owner bears to the total <br />number of parcels within the areas specially benefited. <br />Assessments are to be levied against all lots and lands adjoining <br />and contiguous or bounding and abutting upon the improvements or <br />41 <br />OCTOBER 15, 1996 BOOK 99 ori 439 <br />
