Non -Federal entities may be required to submit a copy of any publication materials, <br />including but not limited to print, recorded, or Internet materials, to the funding agency. <br />iii. When releasing information related to a funded project, non -Federal entities must <br />include a statement that the project or effort undertaken was or is sponsored by DOC <br />and must also include the applicable financial assistance award number. <br />iv. Homeland Security Presidential Directive <br />If the performance of this DOC financial assistance award requires non -Federal entity <br />personnel to have routine access to Federally -controlled facilities and/or Federally - <br />controlled information systems (for purpose of this term "routine access" is defined as <br />more than 180 calendar days), such personnel must undergo the personal identity <br />verification credential process. In the case of foreign nationals, the DOC will conduct a <br />check with U.S. Citizenship and Immigration Services' (USCIS) Verification Division, a <br />component of the Department of Homeland Security (DHS), to ensure the individual is in <br />a lawful immigration status and that he or she is eligible for employment within the <br />United States. Any items or services delivered under a financial assistance award must <br />comply with DOC personal identity verification procedures that implement Homeland <br />Security Presidential Directive 12 (Policy for a Common Identification Standard for <br />Federal Employees and Contractors), Federal Information Processing Standard (FIPS) <br />PUB 201, and OMB Memorandum M-05-24. The recipient must ensure that its <br />subrecipients and contractors (at all tiers) performing work under this award comply with <br />the requirements contained in this term. The Grants Officer may delay final payment <br />under an award if the subrecipient or contractor fails to comply with the requirements <br />listed in the term below. The recipient must insert the following term in all subawards and <br />contracts when the subaward recipient or contractor is required to have routine physical <br />access to a Federally -controlled facility or routine access to a Federally -controlled <br />information system: <br />The subrecipient or contractor must comply with DOC personal identity verification <br />procedures identified in the subaward or contract that implement Homeland Security <br />Presidential Directive 12 (HSPD-12), Office of Management and Budget (OMB) <br />Guidance M-05-24, as amended, and Federal Information Processing Standards <br />Publication (FIPS PUB) Number 201, as amended, for all employees under this subaward <br />or contract who require routine physical access to a Federally -controlled facility or <br />routine access to a Federally -controlled information system. The subrecipient or <br />contractor must account for all forms of Government provided identification issued to the <br />subrecipient or contractor employees in connection with performance under this <br />subaward or contract. The subrecipient or contractor must return such identification to <br />the issuing agency at the earliest of any of the following, unless otherwise determined by <br />DOC: (1) When no longer needed for subaward or contract performance; (2) Upon <br />completion of the subrecipient or contractor employee's employment; (3) Upon subaward <br />or contract completion or termination. <br />Page 49 <br />
