BOOK 99 PAGE 488 <br />BACKGROUND: <br />The existing Horizon Outlet Center, located on the west side of I- <br />95 south of SR 60, was developed at a scale below Development of <br />Regional Impact (DRI) thresholds. However, a proposed expansion of <br />the Outlet Center project will exceed the thresholds and will <br />require DRI approval for the total project area (see attachment <br />#1). Although a formal pre -application conference was held to <br />review a preliminary DRI proposal, no formal DRI application has <br />yet been filed. <br />The Florida Statutes governing DRIs provide for approval of a <br />Preliminary Development Agreement (PDA) to allow development of a <br />portion of the DRI area prior to approval of the DRI. At this <br />time, the owners and developer of the Horizon Outlet Center are now <br />requesting that the Board of County Commissioners approve a PDA to <br />allow development of a portion of the expanded Outlet Center <br />project area prior to approval of a DRI application. <br />ANALYSIS: <br />Normally, PDAs involve only DCA (Department of Community Affairs) <br />and the applicant. However, staff requested that the county be a <br />party to the PDA to ensure that the extent of development under the <br />PDA is limited and to allow county staff review of the "conceptual <br />master plan" that accompanies the PDA. Under the proposed PDA, a <br />golf course and accessory facilities will be the only development <br />allowed prior to review and approval of a DRI application. During <br />review of the DRI application, impacts of all proposed expansion <br />uses will be considered and addressed. <br />The proposed PDA is a three party agreement requiring approval of <br />DCA, the county, and the applicant. As structured, the proposed <br />PDA has been reviewed by county staff, Treasure Coast Regional <br />Planning Council (TCRPC) staff, and DCA staff; none of the staffs <br />object to its approval. The applicant has already executed the <br />proposed PDA (see attachment #2), and DCA staff have indicated <br />that, upon approval by the county, DCA will execute the agreement. <br />The County Attorney's Office has reviewed the PDA and has verified <br />that its form is legally sufficient. <br />The context of the PDA is the proposed DRI project, which will be <br />reviewed in the future by the county, TCRPC, DCA, and other <br />agencies..
