Gentile <br />CET, Civil Engineer <br />SUBJECT: License Agreement between Larmarcus and Rebecca Hornbuckle and Indian <br />River County for 1st Street SW - Indian River County Project No. 8836 <br />DATE: October 11, 1996 <br />DESCRIPTION AND CONDITIONS <br />CONSENT AGENDA <br />1st Street SW between 66th Avenue and 58th Avenue was approved for paving by the Indian <br />River County Board of County Commissioners on October 24, 1995 and is currently under <br />construction. Along this corridor there are several lateral ditch crossings draining properties <br />to the north and also several citrus groves. It is the county's obligation to maintain all <br />existing drainage patterns so that the drainage adjacent to the county right-of-way continues <br />to drain and is not blocked by our construction. During the construction it was brought to <br />our attention that one of the grove owners wanted to install a pump near one of our <br />proposed drainage structures. This pump is to be used by the grove owner to drain his <br />grove during periods of heavy rainfall. At this particular location the right-of-way changes <br />from 60 feet to 80 feet. Apparently at the time Mr. & Mrs. Hornbuckle built their home <br />they deeded 50 feet of right-of-way to the county. Due to the prior donation of right-of-way <br />and the configuration of the ditches it will be necessary to locate this pump in the county's <br />right-of-way near one of the drainage pipes, and the electric service for the pump will be <br />located in close proximity to the pump. A sketch of the area in question is attached. <br />ALTERNATIVES AND ANALYSIS <br />The Engineering Division staff has examined the drainage in this area and feels that this is <br />an acceptable alternative, and the property owners have agreed to this. <br />Per Indian River County Ordinance No. 90-75 where fees were established for use of county <br />right-of-way, the Engineering Division is requesting that this annual fee be waived due to <br />the prior donation of right-of-way. <br />RECOMMENDATION & FUNDING <br />Staff has prepared the attached license Agreement, described the conditions of this <br />agreement, and reviewed it with the property owners. The property owners have signed it <br />and staff is recommending that the Board of County Commissioners execute this license <br />Agreement.
