The required certification form is found in FEMA regulations.54 Each tier must also disclose any <br />lobbying with non-federal funds that takes place in connection with obtaining any federal funding. <br />These disclosures are forwarded from tier to tier, all the way up to the federal awarding agency.55 <br />10.1 Applicability <br />The Byrd Anti -Lobbying Amendment clause and certification are required for contracts of more than <br />$100,000, and for subcontracts of more than $100,000. <br />10.2 Suggested Language <br />The following provides a sample contract clause: <br />"Byrd Anti -Lobbying Amendment, 31 U.S.C. § 1352 (as amended) <br />Contractors who apply or bid for an award of more than $100,000 shall file the required <br />certification. Each tier certifies to the tier above that it will not and has not used federally <br />appropriated funds to pay any person or organization for influencing or attempting to <br />influence an officer or employee of any agency, a Member of Congress, officer or employee of <br />Congress, or an employee of a Member of Congress in connection with obtaining any federal <br />contract, grant, or any other award covered by 31 U.S.C. § 1352. Each tier shall also disclose <br />any lobbying with non-federal funds that takes place in connection with obtaining any federal <br />award. Such disclosures are forwarded from tier to tier up to the recipient who in turn will <br />forward the certification(s) to the federal awarding agency." <br />10.3 Required Certification <br />10.3.1 REQUIRED CERTIFICATION LANGUAGE <br />If applicable, contractors must sign and submit the following certification to the NFE with each bid or <br />offer exceeding $100,000: <br />"APPENDIX A, 44 C.F.R. PART 18 - CERTIFICATION REGARDING LOBBYING <br />Certification for Contracts, Grants, Loans, and Cooperative Agreements <br />The undersigned certifies, to the best of his or her knowledge and belief, that: <br />No federal appropriated funds have been paid or will be paid, by or on behalf of the <br />undersigned, to any person for influencing or attempting to influence an officer or employee <br />54 See 44 C.F.R. §§ 18.100, 18.110; 44 C.F.R.
