<br />WITNESSETH: That whereas, the OWNER and the CONTRACTOR for the
<br />consideration hereinafter named, agree as set forth below:
<br />Article 1. Scope of Work: IRC Bid No. 3032
<br />Installation of utilities on an as -needed basis for labor
<br />(materials to be supplied by OWNER)
<br />The CONTRACTOR, as an independent contractor and not as an agent,
<br />shall furnish, for this labor contract all of the tools, equipment,
<br />labor, and everything necessary to perform, and shall perform, in
<br />accordance with the Contract Documents as set out in Article 7 of
<br />this Agreement, the work of all necessary site preparation, furnish
<br />and install specified facilities specified in the Contract Documents,
<br />including all appurtenances necessary for efficient and effective
<br />operation and shall do everything required in accordance with the
<br />Contract Documents, which are attached hereto and made a part of this
<br />Contract as though bodily incorporated herein.
<br />Article 2. Duration of Agreement:
<br />This agreement shall remain in full force and effect for a period of
<br />Two (2) years after the date of execution thereof or until completion of
<br />all project phases as defined, whichever occurs first, or unless
<br />otherwise terminated by mutual consent of the parties hereto, and
<br />shall be able to be renewed for two one-year periods, upon mutual
<br />agreement of both parties.
<br />Article 3. General:
<br />The CONTRACTOR hereby certifies that he has read each and every
<br />clause of the Contract Documents and that he has made such
<br />examination of the location of the proposed work as is necessary to
<br />understand fully the nature of the obligation herein made; and will
<br />complete the same ir, the time limit specified herein in accordance
<br />with the plans and specifications.
<br />The OWNER and CONTRACTOR herein agree to maintain records, invoices,
<br />and payments for the work.
<br />All work under this Contract shall be done to the satisfaction of the
<br />OWNER, who shall in all cases determine the amount, quality, fitness,
<br />and acceptability of the several kinds of work and materials which
<br />are to be paid for hereunder, and shall decide all questions which
<br />may arise as to fulfillment of the Contract on the part of the
