A TRUE COPY <br />CERTIFICATION ON LAST PAGE <br />RYAN L. BUTLER, CLERK <br />Indian River County BOCC Derelict Vessel Removal Project FWC Contract No. #24230 <br />1.2. Minimum Level of Performance - The vessels and all parts of the vessels listed above shall be <br />completely removed from the waters of the State and all parts of the vessels shall be disposed of as <br />provided. <br />As part of satisfactory completion of this Agreement, the Grantee shall provide to the Commission <br />all documentation required by Attachment H (Grantee's Required Documentation Submission List) <br />at or before the time stated in Attachment H. <br />1.3. Documentation/Criteria for Evaluating the Succoodd Completion of Deliverable Performance <br />Measures) - The Grantee shall provide to the Commission a Final Disposition Report. This report <br />shall contain the list of all derelict vessels removed, the disposition of each derelict vessel, and <br />photographs that document the condition of each vessel prior to removal, the removal process for <br />each vessel, and the final disposition of each vessel. <br />1.4. Timeline for Completion - Final receipts with required evidence of completion will be received by the <br />Commission's Grant Manager no later than 4/30/2025 <br />1.5. Acknowledgment by Grantee's Contractors: For each vessel removed and disposed of pursuant to <br />this Agreement the Grantee shall provide to the Commission written acknowledgement from all of <br />Grantee's contractors of receipt of a copy of this Agreement. Such acknowledgment(s) may be <br />emailed to the Grant Manager and must be received before any work begins under this Agreement. <br />Failure to submit such acknowledgment(s) may result in delays in reimbursement of the Grantee. <br />Section 4. PERFORMANCE MEASURES <br />A. Acceptance of Agreement: <br />The Grantee will accept the agreement, and have it signed and returned to the Commission within <br />30 days of receipt. Failure to have the agreement returned within the specified time will render the <br />agreement null and void. In some cases, the Commission will allow a modified return time with prior <br />notice and approval from the Commission's Grant Manager. <br />B. Commencement of work. <br />The Grantee shall commence work on the overall project as soon as noted by the Commission of <br />the agreement execution. Failure by the Grantee to execute the work within 60 days of agreement <br />execution shall result in the agreement being null and void, unless prior approval for a delay is <br />granted by the Commission's Grant Manager. <br />C. Procurement: <br />The Grantee shall procure goods and services through a competitive solicitation process in <br />accordance with Chapter 287, Florida Statutes. The Grantee has already included in the application <br />the quote provided by the contractor chosen for the task and the Commission will pay to the Grantee <br />100 percent of the quoted price for each task or 100 percent of the actual cost if less than the quoted <br />price. The Grantee will ensure that the selected contractor has adequate insurance and is qualified <br />to do the work. A copy of the state's Derelict Vessel Removal Best Management Practices, attached <br />as Attachment C, will provide guidance as to whether or not the selected contractor is qualified to <br />do the work. <br />Attachment A• Scope of Work Last Revised: 3.23.2023 Page 2 of 5 <br />
