The motion carried by the following vote: <br />Aye: 5 - Chairman Flescher, Vice Chairman Loar, Commissioner Adams, Commissioner <br />Earman, and Commissioner Moss <br />11.A.7. 25-0105 Consideration of an Ordinance of Indian River County, Florida Amending the Zoning <br />Ordinance, and the Accompanying Zoning Map for Approximately ±2.90 Acres from <br />CL, Limited Commercial District to CG, General Commercial District <br />(2005120295-96912) [Quasi -Judicial] <br />Recommended Action: Based on the analysis, Staff and Planning and Zoning Commission recommend that <br />the Board of County Commissioners approve this request to rezone the subject <br />property from CL to CG. <br />Attachments: Staff Report <br />Existing Zoning Mai) <br />Existing Future Land Use Mai) <br />Rezoning Ai)i)lication <br />Draft Ordinance <br />Chairman Flescher introduced the parties for the proceeding as being Kennedy Oslo <br />27, LLC (Applicant) and Indian River County. Each Commissioner, as requested by <br />the Chairman, disclosed ex parte communications, site visits, or independent <br />investigations. The Commissioners also affirmed that they have an open mind and can <br />base their decisions on the evidence presented and the applicable law. The Chairman <br />opened the Public Hearing, and the Deputy Clerk administered the Oath to all <br />persons who wished to speak at the hearing. <br />Senior Planner, Cindy Thurman, Long Range Planning, presented staffs analysis and <br />recommendation for the request to rezone from CL, Limited Commercial District, to <br />CG, General Commercial District. The presentation displayed zoning maps and <br />analyzed the request to ensure it was consistent with Future Land Use Designation <br />and met criteria under Section 902.12(3). Staff concluded that the request was <br />consistent with the Comprehensive Plan and Land Development Regulations, and <br />compatible with the surrounding area. Staff recommended approval of the request, <br />and noted that the Planning and Zoning Commission (PZC) approved the request at <br />their November 14, 2024 meeting. <br />Geoffrey Barkett, Schulke, Bittle, and Stoddard, appeared before the Board on <br />behalf of the Applicant to answer any questions. <br />There being no further comments, the Chairman closed the public hearing. <br />Indian River County, Florida Page 17 <br />
