A TRUE COPY <br />CERTIFICATION ON LAST PAGE <br />RYAN L. BUTLER, CLERK <br />STATE -FUNDED AGREEMENT <br />This State -Funded Agreement (Agreement) is between the Florida Department of <br />Management Services (Department), 4030 Esplanade Way, Tallahassee, Florida, 32399 and <br />Indian River County (Recipient), 4225 43rd Avenue, Vero Beach, FL 32967. <br />The Department and Recipient agree as follows: <br />(1) AUTHORITY <br />A. The Department has been appropriated general revenue funds for the State fiscal year <br />2024-2025, specifically appropriation line item #2971, the nonrecurring sum of <br />$12,000,000 from the Emergency Communications Trust Fund, Chapter 2024-231, <br />Laws of Florida, to fund Public Safety Answering Point (PSAP) Upgrades. The <br />Department has the authority, in accordance with section 282.702 Florida Statutes <br />(F.S.), to enter into this Agreement and to disburse the appropriated funds to the <br />Recipient under the terms and conditions set forth below. <br />B. In accordance with section 215.971, F.S., the Department has the authority to monitor <br />the portion of the State of Florida appropriated funds for the PSAP upgrades. <br />(2) LAWS, RULES, REGULATIONS, AND POLICIES <br />A. This Agreement is executed and entered into in the State of Florida and will be <br />performed, construed, and enforced in accordance with the laws, rules, and <br />regulations of the State of Florida. Each party will perform its obligations in accordance <br />with the terms and conditions of this Agreement. <br />B. The parties shall be governed by all applicable State and Federal laws, rules, and <br />regulations, including but not limited to those identified in Attachment B — Program <br />Statutes and Regulations. Any express reference in this Agreement to a statute, rule, <br />or regulation in no way implies that no other statute, rule, or regulation applies. <br />(3) CONTACT <br />A. In accordance with section 215.971(2), F.S., the Department's Grant Manager is <br />responsible for enforcing the performance of this Agreement's terms and conditions <br />and will serve as the Department's liaison with the Recipient. As part of the duties, the <br />Grant Manager for the Department will: <br />i. Monitor and document Recipient performance of the terms of this Agreement; <br />ii. Review and document all deliverables for which the Recipient requests payment; <br />and, <br />iii. Reconcile and verify all funds received against all funds expended during the <br />agreement period and produce a final reconciliation report which identifies any <br />funds paid in excess of the expenditures incurred by the Recipient. <br />B.
