PF - <br />BOOK 99 PACE 13 - <br />Community Development Director Robert Keating reviewed the <br />Comp Plan amendment process, advising that this is the first public <br />hearing before the Board of County Commissioners on this land use <br />amendment request. If the Board approves the transmittal of this <br />application to the Department of Community Affairs (DCA) in <br />Tallahassee for their 90 -day review, a second and final public <br />hearing will be scheduled to consider any comments made by the DCA <br />and whether to adopt an ordinance amending the Comp Plan by <br />redesignating the land use. If the Board denies the transmittal of <br />an application to the DCA, the application process will come to an <br />end. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. <br />Attorney Michael O'Haire, representing the applicant, advised <br />he is available to answer any questions. <br />Attorney Warren Dill, representing Peter Rodriguez, stated <br />that on November 5th the Board had discussed a potential cap on <br />commercial designations to be allowed at 58th Avenue and SR -60. <br />The main reason for his appearance today was to get a comfort level <br />from the Board so that, should the music stop, they would not be <br />the last left standing. He believed that staff's understanding of <br />the Board's direction was to remove the commercial cap from the <br />Comp Plan. <br />Director Keating advised that the cap will be removed. <br />The Chairman asked if anyone else wished to be heard in this <br />matter. There being none, she closed the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously adopted <br />Resolution 96-140 (Banack) approving the transmittal <br />of a proposed amendment to the Indian River County <br />Comprehensive Plan to the State of Florida <br />Department of Community Affairs for its review. <br />NOVEMBER 12, 1996 <br />48 <br />
