BOOK 99 pn� 749 <br />Based on the analysis, staff and the Planning and Zoning Commission <br />recommend that the Board of County Commissioners transmit this land <br />use amendment to DCA and request DCA and all reviewing agencies to <br />conduct a full review of the amendment. <br />Community Development Director Robert Keating reviewed the <br />Comp Plan amendment process, advising that this is the first public <br />hearing before the Board of County Commissioners on this land use <br />amendment request. If the Board approves the transmittal of this <br />application to the Department of Community Affairs (DCA) in <br />Tallahassee for their 90 -day review, a second and final public <br />hearing will be scheduled to consider any comments made by the DCA <br />and whether to adopt an ordinance amending the Comp Plan by <br />redesignating the land use. If the Board denies the transmittal of <br />an application to the DCA, the application process will come to an <br />end. <br />Commissioner Bird questioned the plan to harvest sand pines to <br />create habitat lands. He felt there should be some other solution. <br />Director Keating stated the harvesting of the sand pines is a <br />part of the habitat conservation plan which generally enhances the <br />habitat of the scrub jay. We are trying to put the area back to <br />what it was formerly. <br />Commissioner Tippin strongly suggested that the mating season <br />of gopher turtles not be interfered with, and Director Keating <br />confirmed that staff is consulting with Fish & Wildlife regarding <br />the plan. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, she closed <br />the public hearing. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Eggert, the Board unanimously adopted <br />Resolution 96-143 (Wabasso Scrub Conservation Area) <br />approving the transmittal of a proposed amendment to <br />the Indian River County Comprehensive Plan to the <br />State of Florida Department of Community Affairs for <br />its review. <br />NOVEMBER 12, 1996 84 <br />
