Bunt, Assistant County Administrator <br />Addie Javed, P.E., Public Works Director <br />Adam Heltemes, P.E., Roadway Production Manager <br />FROM: Jill Williams, Contract Support Specialist <br />DATE: March 13, 2025 <br />W— <br />Indian <br />River County <br />Administration Complex <br />1801 27th Street <br />Vero Beach, Florida 32960 <br />indianriver.gov <br />Meeting Date: 4/8/2025 <br />SUBJECT: Florida Department of Transportation (FDOT) Memorandum of Agreement (MOA) for <br />82°d Avenue/CR619 from 261 Street to 69h Street, Financial Project No. 230879-3, IRC - <br />1756 <br />BACKGROUND <br />Florida Department of Transportation (FDOT) requires that the local agency governing board approve a <br />resolution accepting the attached Memorandum of Agreement (MOA) outlining conditions for the acceptance <br />and maintenance of properties acquired for the project before and during construction of the project. The use of <br />Federal funding for the maintenance of the acquired property before and during construction is not allowable <br />for off -system projects. The resolution endorses FDOT's delivery of the project that is within the local agency's <br />right of way or local jurisdiction. <br />ANALYSIS <br />The County will be responsible for the maintenance of all property acquired for right-of-way prior to and <br />during construction which includes responding to and addressing Code Enforcement violations and complaints <br />from the public as well as any required mowing and litter removal during construction. <br />BUDGETARY IMPACT <br />Maintenance expenses of the acquired properties will be included in the Public Works Road and Bridge <br />Division budget.
