Shuler, County Attorney <br />THROUGH: Kylie Yanchula, Natural Resources Department Director <br />FROM: Eric Charest, Natural Resources Manager <br />SUBJECT: Local Government Funding Request Grant Agreement 211R1, Amendment <br />#3 Execution <br />DATE: May 9, 2025 <br />DESCRIPTION AND CONDITIONS <br />On May 19, 2021, FDEP entered into Local Government Funding Request (LGFR) Grant Agreement <br />No. 211R1 with Indian River County, committing up to $326,329 at a 46.65% State/53.35% County <br />cost share ratio for construction and post -construction required monitoring costs associated with <br />the County's Sector 5 Beach and Dune Restoration Project which completed construction in <br />March of 2020, with on-going post -construction monitoring. <br />FDEP Grant 211R1 specifies a cost share between the State and County for non -Federally <br />reimbursed expenses. Due to the terms of the original 211R1 agreement initially expiring on <br />December 31, 2023, County staff requested the FDEP issue an extension to Grant 211R1 in the <br />form of Amendment #1. On January 23, 2024, the County received Amendment #1 to 211R1 <br />which extended the grant for twelve (12) months while maintaining the same level of funding. A <br />second extension to LGFR Grant 211R1 was requested by the County due to the lengthy process <br />of finalizing FEMA reimbursement strategies. On January 14, 2025 the Board approved the Staff <br />recommendation below: <br />"Staff recommends the Board approve FDEP Amendment #2 to FDEP LGFR Grant Agreement <br />211R1 and authorize the County Administrator to sign this Amendment. Staff is also <br />recommending the Board further authorize the County Administrator to sign any future <br />Amendments to LGFR 211R1 that do not alter its' financial terms on behalf of the County." <br />Amendment #2 was executed on January 31, 2025 extending the terms of the grant through <br />December 31, 2025. <br />Staff have been working with the FDEP on maximizing the reimbursements possible under grant <br />211111, as such, Staff formalized a request to the FDEP on May 5, 2025 for them to reallocate <br />approved reimbursement funds within Grant 211111. Cost -share reimbursement funds originally <br />allocated to Tasks 1.1 and 1.2 (construction related funds) were requested to be reallocated to <br />Task 2 (post -construction monitoring), where the County could utilize more of the available <br />funding identified in the grant. The FDEP has offered the County Amendment #3 to Grant 211R1 <br />
