Prado, Deputy County Attorney <br />DATE: May 6, 2025 <br />Indian River County <br />Administration Complex <br />1801 27th Street <br />Vero Beach, Florida 32960 <br />indianriver.gov <br />Meeting Date: 5/20/2025 <br />SUBJECT: Drainage Easement for Ganbin/Jackson Eminent Domain Settlement <br />BACKGROUND <br />This case is the last eminent domain case open for the 66' Avenue Road widening project. The case <br />initially started in December 2021. On December 17, 2024, the Board approved a counteroffer that was <br />received from the Respondents/property owners in that case to settle the eminent domain case in the amount of <br />$72,240.00 inclusive of attorney's fees and costs. This was to be along with other non -monetary compensation <br />sought by the Respondents/property owners of 20 loads of fill delivered to their property, three (3) driveway <br />aprons from the new property line to the new edge of 66' Avenue, and a drainage easement that allowed the <br />Respondents to drain from their property south to the Lateral R -14E Canal which is controlled by Sebastian <br />River Drainage District. <br />The court has entered a final judgment in this case enforcing the settlement agreement which includes <br />all of the above-mentioned terms. The drainage easement needs to be approved and signed off by the Board so <br />that it may be recorded in the public records of the County and therefore enabling the County to comply with <br />the final judgement in this case. <br />ANALYSIS <br />N/A <br />BUDGETARYIMPACT <br />Funding in the amount of $ 78.00 for the recording fees will be budgeted and available from Optional Sales <br />Tax/Road/Bridge/Right of Way/ 66th Ave/69th Street to 85th Street, Account # 31521441-066120-16009 for <br />FY24/25. <br />Indian River County, Florida Page 1 of 2 Printed on 5/15/2025 <br />powered by Legistar- 46 <br />
