CLARK <br />ANDREW GILES FAY <br />GABRIELLA PASSIDOMO SMITH <br />ORDER SUSPENDING TARIFF <br />Section 366.91(3), Florida Statutes (F.S.), requires each investor-owned utility to <br />continuously offer to purchase capacity and energy from renewable generating facilities and <br />small qualifying facilities. Rules 25-17.200 through 25-17.310, Florida Administrative Code <br />(F.A.C.), implement the statute and require each investor-owned utility to file with the <br />Commission, by April 1 of each year, a revised standard offer contract based on the next <br />avoidable fossil -fueled generating unit of each technology type identified in the utility's current <br />Ten -Year Site Plan (TYSP). <br />We have jurisdiction over this amended standard offer contract pursuant to Sections <br />366.04, 366.041, 366.05, 366.055, 366.06, and 366.9 1, F.S. <br />On April 1, 2025, Florida Power & Light Company (FPL) filed a petition for approval of <br />its amended standard offer contract based on its 2025 TYSP in accordance with Rule 25-17,250, <br />F.A.C. Pursuant to Section 366.06(3), F.S., we must respond to FPL's petition within sixty days <br />or the revised renewable energy tariff will automatically become effective. <br />We find that the proposed tariff shall be suspended to allow sufficient time to review the <br />petition and gather all pertinent information in order to present an informed recommendation on <br />the tariffs proposal. Failure to suspend the proposed tariff within sixty days will result in the <br />tariff becoming effective. <br />Pursuant to Section 366.06(3), Florida Statutes, we may withhold consent to the <br />operation of all or any portion of a new rate schedule, delivering to the utility making the request <br />a reason or written statement of good cause for doing so within sixty days. <br />We find that taking time to thoroughly review the petition and gather information is good <br />cause consistent with the requirement of Section 366.06(3), F.S., and, therefore, the tariff shall <br />be suspended. The proposed tariff is suspended to allow our staff sufficient time to review the <br />petition, gather all pertinent information, and to present an informed recommendation on the <br />g-1 <br />
