STATUTE 196.015 <br /> 196.015 Permanent cy; factual determination establish <br /> permanent residence in this state is a factual determination to be made, in the first instance, by the property <br /> appraiser. Although any one factor is not conclusive of the establishment or nonestablishment of permanent <br /> residence, the following are relevant factors that may be considered by the property appraiser in making his or <br /> her determination as to the intent of a person claiming a homestead exemption to establish a permanent <br /> residence in this state: <br /> (1) A formal declaration of domicile by the applicant recorded in the public records of the county in which the <br /> exemption is being sought. <br /> (2) Evidence of the location where the applicant's dependent children are registered for school. <br /> (3) The place of employment of the applicant. <br /> (4) The previous permanent residency by the applicant in a state other than Florida or in another country and <br /> the date non-Florida residency was terminated. <br /> (5) Proof of voter registration in this state with the voter information card address of the applicant, or other <br /> official correspondence from the supervisor of elections providing proof of voter registration, matching the <br /> address of the physical location where the exemption is being sought. <br /> A valid Florida driver license issued under s. 322.18 or a valid Florida identification card issued under s. <br /> ' 322.051 and ividence of relinquishment of driver licenses from any other states. <br /> (7) |�nu�Do� ofGF|orid� |iceD�a[e�oDanyrno�orvmhiC|m�V«D�dbVthaGpp||��OL <br /> ) <br /> (8) The address as listed on federal income tax returns filed by the applicant. <br /> (9) The location where the applicant's bank statements and checking accounts are registered. <br /> (10) Proof of payment for utilities at the property for which permanent residency is being claimed. <br /> FINDINGS OF FACT <br /> FOR THE PROPERTY APPRAISER: Veronica Jarman testified. Testified that the issue via the Florida Statute <br /> 196.031 in the instant matter is one of the subsection (1) (a) and the "A person who, on January 1, has the <br /> legal title or beneficial title in equity to real property in this state and who in good faith makes the property his <br /> or her permanent residence or the permanent residence" clause of the statute as the basis for the denial by <br /> the Property [)ff|oe |Dthe instant n1a� Testified Te� �edthat the ''Pornlanentresidency; factual <br /> determination' byproperty appraiser"from Florida Statute 108.O15was also a basis for the denial by the <br /> Property Appraiser in the instant matter, in particular, the subsection (6) and the"A valid Florida driver license <br /> issued under s. 322.18 or a valid Florida identification card issued under s. 322.051 and evidence of <br /> relinquishment of driver licenses from any other states1' language that the Property Appraiser's Office argued <br /> that the Petitioner's evidence did not comport with the meaning of the statute and the aforementioned <br /> subsections. <br /> Testified that the instant matter is one of new home construction and that the instant matter is one of a new <br /> ' application fr the homestead relief that the Petitioner seeks. Testified that the application was filed <br /> on12/7/2023. Testified that the Petitioner is active military and here in the state on orders. Testified that the <br /> Petitioner still has a Texas driver's license and that the Petitioner has not applied for a Florida driver's license. <br /> Testified that the Texas driver's license is for a Texas resident benefit (exhibit E in the Property Appraiser <br /> evidence package.) Testified that the issue for the Property Appraiser is the Petitioner keeping the Texas <br /> driver's license for a residential benefit and by doing so the benefit makes the Petitioner a Texas resident. <br /> Testified that the aforementioned does not comport with subsection (4) and the "previous permanent <br /> residency by the applicant in a state other than Florida or in another country and the date non-Florida <br /> residency was terminated" language of Florida Statute 196.015 nor does it comport with subsection (6) and the <br /> "A valid Florida driver license issued under s. 322.18 or a valid Florida identification card issued under s. <br /> 322.051 and evidence of relinquishment of driver licenses from any other states" language of Florida Statute <br /> 198.015. Testified that the Texas driver's license has a "permit basis"for the state of Texas for the Petitioner <br /> to hunt and fish at no cost. <br /> PROPERTY APPRAISER'S EVIDENCE was re|evant, admissible and credible. <br /> -26 - <br />
