<br />THIS GRANT OF EASEMENT, made and executed this �4�\day of A31tA,
<br />2025, by GRAND HARBOR NORTH LAND LLC, a Delaware limited liability, ompany,
<br />whose principal place of business is 16690 Collins Ave, PH, Sunny Isles Beach, FL 33161,
<br />hereinafter called GRANTOR, to INDIAN RIVER COUNTY, a political subdivision of the
<br />State of Florida, having a mailing address of 1801 27th Street, Vero Beach, Florida 32960,
<br />hereinafter called GRANTEE.
<br />WITNESSETH:
<br />That GRANTOR for and in consideration of the sum of TEN DOLLARS ($10.00) and
<br />other valuable consideration, receipt of which is hereby acknowledged by these presents does
<br />grant, bargain, sell, alien, remise, release, convey, and confirm unto the GRANTEE, a non -
<br />exclusive perpetual utility easement ("Easement") to install, construct, operate, maintain,
<br />repair, replace, and remove Grantee's electrical line that is located in, on, over, across and
<br />under the following described land, situate in Indian River County, Florida, to -wit:
<br />See Exhibit "A" attached hereto (the "Easement Area").
<br />And GRANTOR hereby covenants with said Grantee that the Grantor is lawfully seized
<br />of said servient land in fee simple, and that the Grantor has good right and lawful authority to
<br />convey the easement established hereby and will defend the same against the lawful claims of
<br />all persons whomsoever.
<br />The Easement herein granted is subject to covenants, restrictions, easements, liens,
<br />and encumbrances of record.
<br />Grantor reserves the right and privilege to use and occupy the surface and air space
<br />over the Easement Area for any purpose which is consistent with the rights herein granted to
<br />Grantee and not inconsistent with Grantee's use.
<br />Grantee shall exercise the easement rights conveyed herein in a manner which will not
<br />unreasonably interfere with the use and occupancy of improvements constructed upon the
<br />adjacent property owned by Grantor.
<br />With regard to the electrical line as to which easement rights are herein granted,
<br />Grantee will repair, replace and maintain such electrical line at its own expense. In connection
<br />with any repair, replacement or maintenance of said electrical line, Grantee shall promptly
<br />restore the premises to substantially the same condition as existed prior to such repair,
