The County should also continue to use the Tourist <br />Development Tax and the Local Option Sales Tax to match State funds for financing future Indian River <br />County beach projects, <br />coordinating with the Sebastian Inlet Tax District and the City of Vero Beach on beach restoration <br />projects; and <br />continuing meetings of a beach preservation and restoration advisory committee concerning <br />recommendations unrelated issues. <br />Policy 10.4: To protect existing dune communities and reduce shoreline soil erosion, the c -County shall <br />continue to prohibit development encroachment e,.o.,,,war-d of the eounty dune stabilization setb ,^v line <br />excavation or manmade structure seaward of the county dune stabilization setback line (DSSL), <br />with the exception of dune approved dune walkovers and or other similar minor structures sus <br />,approval as defined by the FDEP Bureau of Beaehes.-4-and-C1-aastal-Systems. By 2012, the county will <br />� V ULUULV L11Li 1VliL[Lion ef the DS SL and will eensidef feleeating the DSSL westwafd. <br />Policy 10.5: The eCounty hereby adopts the following specific criteria pertaining to shoreline <br />stabilization within the unincorporated portion of Indian River County and all oceanfront properties b <br />munieipal limits of the City of Ver -e Beach: <br />Rigid permanent shoreline protection structures shall be permitted if: The bulkhead or seawall <br />is necessary to protect real property improvements from a twenty -five-year or less intensity storm <br />event, utilizing methods approved by the Division of Beaches as Shores of the Florida <br />Department of Natural Resources: <br />Rigid structures may be permitted if the County engineering department and the Division of <br />Beaches and Shores of the Florida Department of Natural Resources recommendations include <br />the utilization of a rigid structure over other alternatives; <br />All shoreline stabilization projects shall be approved by the Ceff .,. unity Development --Planning <br />and Development Services Department, excluding those projects! eligible for an emergency <br />permit under Chapter 161, F.S., as authorized by the Public Works Director; <br />Rigid shoreline stabilization structures shall not be permitted on vacant properties; <br />The subject property owner(s) shall be required to assume responsibility for and agree to <br />mitigate any adverse environmental impacts attributed to the stabilization project, including <br />increased down -drift erosion to the adjacent property, throughout the life of the stabilization <br />project; <br />Construction activity oceanward of the County's DSSL Dune Stab liza4 a Seth ^t_ Line <br />`nom shall be avoided to the maximum extent possible, and prohibited during sea turtle <br />nesting season (March 1 to October 31) unless expressly approved by the Florida Department of <br />Environmental Protection (FDEP). <br />The Countv should continue to enforce its sea turtle protection ordinance in order to protect <br />sea turtles along the County's beaches. Efforts shall be made to make beachfront lighting <br />ordinances within the County uniform; <br />It is the policy of the Indian River County Board of County Commissioners (BOCC) that no <br />light illuminate any area of the beaches of unincorporated Indian River County Florida during <br />the period of the year when sea turtles nest (March 1 to October 31).
