Contractor Maintenance Building: A building owned by the County that is located at the Landfill for the
<br />Contractor to occupy and utilize during the term of the Agreement.
<br />Contract Manager: The person designated by SWDD to act as SWDD's representative during the term of
<br />this Agreement.
<br />Critical Equipment: Equipment deemed essential to the operation of the Site and identified by Bidder
<br />during the procurement process.
<br />Day: One calendar day unless otherwise specified herein.
<br />Declaration of Emergency: A formal notification that may be provided to the Contractor by SWDD after a
<br />declaration of emergency is issued by the State of Florida or the County pursuant to Chapter 252, Florida
<br />Statute.
<br />Disaster: Shall mean any natural, technological, or civil emergency that causes damage of sufficient
<br />severity and magnitude to result in a declaration of a state of emergency by the Board, the Governor, or
<br />the President of the United States.
<br />Disaster Debris: Shall reference scattered items and materials either broken, destroyed, or displaced by
<br />a Disaster, including, but not limited to, trees and woody debris, construction and demolition materials,
<br />personal property and/or mud, silt, gravel and sediment.
<br />Effective Date: The date this Agreement has been fully executed by both the SWDD and Contractor.
<br />Hazardous Waste: as defined in Chapter 62-730, FAC, as amended from time to time; the Resource
<br />Conservation and Recovery Act, 42 USC 82, and implementing regulations, as amended from time to time;
<br />or Section 403.703(21), F.S., and provided here: Solid Waste, or combination of Solid Wastes, which
<br />because of its quantity, concentration, or physical, chemical or infectious characteristics, may cause, or
<br />significantly contribute to, an increase in mortality or an increase in serious irreversible or incapacitating
<br />reversible illness or may pose a substantial present or potential hazard to human health or the
<br />environment when improperly transported, disposed of, treated, or otherwise managed. The term does
<br />not include human remains that are disposed of by persons licensed under chapter 497. In addition to the
<br />foregoing definition, any material or substance identified in the Florida Administrative Code Rule 62-730,
<br />and 40 Code of Federal Regulation, Part 261 is also included. Hazardous Waste is not accepted at the IRC
<br />Class 1 Landfill.
<br />Holidays: Shall mean Independence Day, Labor Day, Thanksgiving Day, Christmas Day, and New Year's
<br />Day.
<br />Household Hazardous Waste (HHW): The Florida Department of Environmental Protection (FDEP) defines
<br />household hazardous waste (HHW) as leftover household products that contain toxic, corrosive, ignitable,
<br />or reactive ingredients. HHW includes but is not limited to paints, cleaners, oils, batteries, pesticides, lawn
<br />chemicals, and fluorescent lamp bulbs.
<br />Landfill: The Indian River County Solid Waste Landfill.
