600K 99 f,, fad 887 <br />a) Protection of Beach and Dune System - The applicants have stated that the <br />"structures are designed to minimize impacts to the beach dune system. " <br />Construction will take place by placing and operating a crane seaward of <br />the wall. Access to the beach will be from private property after approval <br />by the property owner. <br />b) Siting and Design Criteria for the Protective Structure - The applicants have <br />stated that the structures are as far landward as is practicable. <br />A drawing showing wall location was submitted to staff and the FDEP on <br />Nov. 15, 1996. Staff does not concur with the location of the wall along the <br />Bunger property since it is seaward of the alignment already approved by <br />the FDEP. Staff recommends a more landward placement in conformance <br />with the draft DEP permit if an emergency permit is issued. County staff <br />and FDEP staff are of the opinion that the alignment of the wall along the <br />Papin property is reasonable. An alignment between the Bunger and Papin <br />properties should be as landward as reasonable. The sheet pile seawall <br />with a concrete cap and deadmen is adequate structurally as designed by <br />a structural engineer. <br />c) Impacts on Adjacent Properties - The applicants' Coastal Engineer, Coastal _ <br />Technology, Inc. Michael Walther, P.E., has rendered the opinion that there <br />will be no adverse impact on adjacent properties for at least 10 years (see <br />attached report). <br />d) Preservation of Public Beach Access - No seawalls will be built along public <br />access frontage. <br />e) Protection of Native Coastal Vegetation and Nesting Marine Turtles and <br />their Hatchlings." All coastal vegetation disturbed will be restored. As little <br />disturbance to vegetation as possible will occur. No work will be performed <br />during turtle nesting season. <br />In considering the County Code, some of the property owners have nourished <br />and/or planted the coastal dune, but erosion has continued. No other techniques <br />to stabilize the dune have been used, to staffs knowledge. The applicant's <br />attorney has also stated in his Nov. 7, 1996 letter that "the applicants will <br />certainly carefully consider mitigation should that be an issue. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends that a FS Chapter 161.086 (b) Emergency Permit be issued for <br />the Bunger and Papin properties at this time subject to the following conditions: <br />1) Seaward of the wall, beach compatible sand is placed to reestablish <br />the beach and dune system. Substantial accretion occurred <br />yesterday which should not be eliminated. <br />2) The seawall be placed as landward as possible. For the Bunger <br />residence, the permitted D.E.P. alignment is recommended. For the <br />Papin property, a location 15± from the existing house is <br />recommended. <br />3) Any adverse impacts created by the seawall an adjacent properties be <br />mitigated by sand placement to be determined by staff. <br />4) All public access shall be retained. <br />5) The construction shall have minimum impact on native coastal <br />vegetation and any native vegetation removed or damaged will be <br />replaced. No construction -.shall occur during the turtle nesting <br />season. <br />6) The emergency seawall shall be temporary and shall be removed <br />unless a F.D.E.P. permit for a permanent seawall is acquired. <br />NOVEMBER 19, 1996 30 <br />
