A TRUE COPY <br />CERTIFICATION ON LAST PAGE <br />RYAN L. BUTLER, CLERK <br />FWC Agreement No. #25203 <br />I. Procurement of Recovered Materials <br />In the performance of this Agreement, the Recipient shall make maximum use of products <br />containing recovered materials that are EPA -designated items unless the product cannot be <br />acquired— <br />a. Competitively within a timeframe providing for compliance with the Agreement <br />performance schedule; <br />b. Meeting Agreement performance requirements; or <br />c. At a reasonable price. <br />ii. Information about this requirement, along with the list of EPA- designated items, is <br />available at EPA's Comprehensive Procurement Guidelines. <br />iii. The Recipient also agrees to comply with all other applicable requirements of Section 6002 <br />of the Solid Waste Disposal Act. <br />J. Domestic Preference for Procurements <br />i. As appropriate and to the extent consistent with law, the Recipient should, to the greatest <br />extent practicable under a Federal award, provide a preference for the purchase, acquisition, <br />or use of goods, products, or materials produced in the United States (including but not <br />limited to iron, aluminum, steel, cement, and other manufactured products). The <br />requirements of this section must be included in all subcontracts including all contracts for <br />work or products under this Agreement. <br />ii. For purposes of this section: <br />a. "Produced in the United States" means, for iron and steel products, that all <br />manufacturing processes, from the initial melting stage through the application of <br />coatings, occurred in the United States. <br />b. "Manufactured products" means items and construction materials composed in whole <br />or in part of non-ferrous metals such as aluminum; plastics and polymer -based products <br />such as polyvinyl chloride pipe; aggregates such as concrete; glass, including optical <br />fiber; and lumber. <br />K. Compliance with Office of Management and Budget Circulars. <br />As applicable, Recipient shall comply with the following Office of Management and Budget <br />(OMB) Uniform Guidance (2 CFR 200). <br />L. Drug Free Workplace. <br />Pursuant to the Drug -Free Workplace Act of 1988, the Recipient attests and certifies that the <br />Recipient will provide a drug-free workplace compliant with 41 U.S.C. 81. <br />Recipient/Subrecipient Agreement Last Revised: 04/29/2025 Page 24 of 34 <br />
