Design -Build Contract <br />PART 1 CONTRACT <br />This Part 1 Contract (Contract) for design -build services is made and entered into this 21st day <br />of October, 2025 by and between Indian River County, a Political Subdivision of the State of <br />Florida organized and existing under the Laws of the State of Florida, hereinafter referred to as <br />the "Owner," and Ric -Man Construction Florida Inc., a Florida Corporation, authorized to do <br />business in the State of Florida, hereinafter referred to as the "Design -Builder". <br />For the following Project: Ixora Park Infrastructure Improvements (RFQ 2024030) <br />The architectural/engineering services described in Article 1 will be provided contractually <br />through the Design -Builder by the following person or entity who is lawfully licensed to practice <br />architecture/engineering: <br />Wade Trim, Inc. <br />201 N. Franklin Street, Suite 1350 <br />Tampa, FL 33602 <br />Normal civil, structural, mechanical and electrical engineering services will be provided <br />contractually through the Design -Builder as indicated below: <br />PRE -CONSTRUCTION SCOPE OF SERVICES PHASE I ATTACHMENT 3 <br />The Owner and Design -Builder agree as set forth below. <br />ARTICLE 1 <br />DESIGN -BUILDER <br />1.1 SERVICES <br />1.1.1 Conceptual, schematic, design development, and construction documents, budget, and <br />schedule comprise the services required to accomplish the preparation and submission <br />of the Design -Builder's Guaranteed Maximum Price (GMP) Proposal, as well as the <br />preparation and submission of any modifications to the GMP Proposal prior to execution <br />of the Part 2 Contract. <br />1.2 RESPONSIBILITIES <br />1.2.1 The services that the Design -Builder will provide to the Owner under this Contract will be as <br />follows, and in general accordance with the Owner's Request for Qualifications (RFQ) 2024030, issued <br />on January 7, 2024, entitled "Request for Qualifications for Progressive Design -Build Services for Ixora <br />Park Infrastructure Improvements", which is incorporated by reference herein, and the Design - <br />Builder's Design -Builder's fee and scope of work proposal, submitted October 8, 2025, which is <br />attached hereto and incorporated by reference herein. In the event of any conflicts between this Contract <br />and any other documents, the precedence in resolving such conflicts will be as follows: <br />Ixora Park Infrastructure Improvements <br />
