Board of County Commissioners Meeting Minutes - Final September 9, 2025 <br />There was no discussion on the Public School Facilities Sub -element. <br />Property Rights Sub -element <br />Mr. Sweeney explained that Policy 1.3, which was crossed out, was adopted in an <br />earlier year but somehow didn't make it into the Plan. He noticed that this detail had <br />been overlooked and left out. The policy had received approval as written; it was <br />simply omitted and was being reinstated in the Plan. <br />Final Comments <br />Administrator Titkanich reminded the Board that, with the proposed changes, this <br />document would serve as the transmittal. He stated that if anything had been missed, <br />the review process would continue when the actual adoption returned. He expressed <br />confidence that if errors were identified, they would be brought to his attention and <br />addressed accordingly. He believed that with the Planning staff, his oversight, and all <br />the notes taken, along with collaboration from the County Attorney's Office and the <br />Subject Matter Experts who had been present at various times regarding their areas, <br />everything would be done correctly. <br />A discussion ensued between the Board and staff regarding whether the final <br />document could be presented to the Board at a future meeting before submission. <br />Deputy County Attorney Susan Prado stated that the Board was bound by Florida <br />Statute Subsection 163.3184, which clearly specified that each local governing body <br />proposing a plan or plan amendment mentioned in paragraph 2C was required to <br />transmit the complete proposed Comprehensive Plan or Plan Amendments to the <br />reviewing agencies within 10 working days after the first public hearing. Therefore, <br />unless the Board decided to continue the public hearing, the proposal must be <br />transmitted within 10 days from this meeting. <br />Chairman Flescher recognized the tight schedule the Board was facing, noting that <br />they were in a difficult position unless a further extension of the public hearing was <br />granted. The proposed changes had been thoroughly reviewed, and there was <br />confirmation that the staff had listened to the concerns and made the necessary <br />adjustments. <br />It was the consensus of the Board not to extend the public hearing. <br />The Chairman closed the public hearing. <br />Indian River County, Florida Page 31 <br />
