Old Dixie Highway Crossing with this Stipulation of Parties. <br />10. Upon compliance with the terms of this Stipulation of Parties, the COUNTY, RAILROAD, and <br />DEPARTMENT agree that the Old Dixie Highway Crossing hereafter in fact shall be a closed <br />railroad -highway grade crossing. <br />11. The terms of this Stipulation of Parties may not be changed, waived, discharged, or terminated <br />orally, but only by an instrument or instruments in writing, signed by RAILROAD, COUNTY, <br />and DEPARTMENT. <br />12. This Stipulation of Parties is governed by and shall be interpreted and construed in accordance <br />with the laws of the State of Florida. Each Party will bear its own attorney's fees and costs in <br />any disputes, controversies, claims, and/or proceedings that may arise from this Stipulation of <br />Parties. <br />13. Any failure of any Party to insist upon the strict performance of any terms or provisions of this <br />Stipulation of Parties is not deemed to be a waiver of the terms of this Stipulation. <br />14. As authorized by Section 335.141, Florida Statutes, and Rule Chapter 14-57, Florida <br />Administrative Code, the DEPARTMENT permits the closure of the Old Dixie Highway <br />Crossing, as evidenced by this Stipulation of Parties, provided all conditions are met and <br />completed within 60 months of the execution of this Stipulation. <br />15. This Stipulation of Parties may be executed in any number of counterparts, each of which shall <br />be deemed an original, but all of which shall constitute the same instrument.
