Finney, SRA. <br />County Right -of -Way Agent <br />SUBJECT: 26th Street Right -of -Way Acquisition; Parcel #101 <br />DATES November 17, 1995 <br />DESCRIPTION AND CONDITIONS <br />Sixty feet of additional right-of-way is required for the paving <br />improvement project between 58th Avenue and 66th Avenue on 26th <br />Street. <br />Consideration for the donated right-of-way will be no assessment <br />for paving, construction, utilities, drainage or any other expenses <br />associated with 26th Street improvements. <br />There are no appraisal fees or attorneys fees. The cost to <br />purchase by Eminent Domain would be more than the contract <br />consideration and the settlement is equitable in lieu of <br />condemnation. <br />RECONIlYRENDATION <br />Staff requests the Board of County Commissioners approve the <br />contract and authorize the Chairman to execute the contract. <br />NOVEMBER 28, 1995 14 <br />
