Grant of Easement - 10 Foot Strip of Land Between <br />Indian River Mall and Indian River Square Developments <br />- Lowe's Home Center, Inc. - Indian River Mall Associates <br />- Indian River Square Limited Partnership - Dayton Hudson <br />Corporation <br />The Board reviewed a Memorandum of December 9, 1996: <br />TO: The Board of County Commissioners <br />FROM: ;� William G. Collins II - Deputy County Attorney <br />DATE: December 9, 1996 <br />SUBJECT: Grant of Easement of 10 -Foot Strip of Land Lying Between the <br />Indian River Mall and the Indian River Square Developments <br />On August 20, 1966 the Board of County Commissioners accepted a Quit -Claim <br />Deed from the Indian River Farms Water Control District for a 10 -foot strip <br />of land lying between the Indian River Mall and the Indian River Square <br />developments. <br />At that time the County Commission authorized the Chairman to execute an <br />easement running in favor of the owners of the Indian River Mall and Indian <br />River Square projects which would allow the 10 -foot strip to be utilized by <br />the grantee for the purpose of common ingress, egress, access, <br />cross -connection of internal driveways, landscaping, sodding and irrigation <br />of any medians within such common access driveways, pedestrian <br />inter -connections, electrical conduit under the strip, utilities, drainage, <br />etc. <br />The 10 -foot strip over which the easement is to be granted lies between the <br />two projects at the point where FDOT has required the developers to have a <br />joint ingress/egress access point on S.R. 60 at their common property lines. <br />RECOMMENDATION• <br />Authorize the Chairman to execute the attached Easement, as approved in <br />concept on August 20, 1996. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Ginn, the Board unanimously approved <br />the Grant of Easement to Lowe's Home Center, Inc., <br />IR Mall Associates,, Ltd., Indian River Square <br />Limited Partnership, and Dayton Hudson Corporation, <br />and authorized the Chairman to execute same, as <br />recommended by staff. <br />EASEMENT IS ON FILE IN THE OFFICE <br />OF THE CLERK TO THE BOARD <br />DECEMBER 17, 1996 29� �`L E4 <br />
