Chairman Eggert questioned whether that future site plan would <br />pose a problem, and Director Davis responded that there is a <br />question as to whether or not Mr. Morris will split the parcel but <br />he could access 10th Street which would solve the issue of <br />disturbing the trees. <br />Director Davis did not know whether Mr. Morris would have a <br />preference for access on 10th Street or 21st Avenue, but he would <br />have legal access to 10th Street. <br />Mr. Cain continued that staff could put in a culvert but if <br />Mr. Morris built a driveway (anywhere from 12 to 18 feet) that <br />would take out a couple of the trees. <br />Mrs. Pickles felt installing the culvert would damage the <br />trees and could see no point in installing a culvert if Mr. Morris <br />has access to a street where there are no trees (10th Street). She <br />also mentioned a pine tree which will be impacted by 7 feet on the <br />project plan and wondered if staff could back up a few feet to <br />spare that tree. <br />Robert Oziemkowski, 956 21st Avenue, expressed his concerns <br />regarding notification of the surrounding property holders. He <br />stated that he would never have voted for the project had he <br />realized there would be any damage to the trees as he had <br />understood that the Board guaranteed preserving them. <br />Letha Rhodes, 965 21st Avenue, wanted a new assessment as she <br />felt she would not benefit from 21st Avenue. She also wanted to <br />know whether Mr. Morris would be charged a portion of the <br />assessment if he is allowed to access 21st Avenue. <br />Director Davis reminded everyone that the public hearing in <br />January of 1996 was an opportunity for the property owners in the <br />benefitted area to come before the Board and petition to be <br />included or not. Staff has no way to know which property owners <br />would want to split their properties in the future. This project <br />was authorized by resolution at that public hearing.
