ANALYSIS <br />The comprehensive plan amendment process generally takes from 6 <br />months to a year before an amendment is ultimately approved or <br />denied by the Division of Resource Planning and Management of the <br />State Department of Community Affairs (DCA). Even if the amendment <br />process is initiated immediately by the City and Town, it will <br />likely be after the current June expiration date of the FCT grant <br />before the amendments are approved or denied. Notwithstanding, if <br />the comprehensive plan amendments are initiated and re -appraisals <br />are obtained, this showing of progress in negotiations will lend <br />towards the County's chances of getting an additional grant <br />extension if necessary. <br />If new appraisals are obtained by the FCT based on the recent <br />actions by the City of Vero Beach and the Town of Indian River <br />Shores, the resulting appraised values will not be valid until and <br />unless the amendments are ultimately approved by the DCA. <br />Consequently, any negotiations based on new appraisals cannot <br />meaningfully occur until DCA's review and approval process has run <br />its course. <br />The County and the State have already spent money obtaining two <br />appraisals and a third review appraisal. Staff's position is that <br />it would be appropriate to request that the seller pay for any re- <br />appraisals of the islands. If the seller agrees to pay for the re- <br />appraisals, those appraisals would be confidential to the State and <br />County, in accordance with State requirements. <br />RECOMMENDATION: <br />Staff recommends that the Board authorize staff to send a letter to <br />the Florida Communities Trust requesting that the FCT obtain re- <br />appraisals of the Lost Tree Islands based on the recent local <br />government actions, with the expressed understanding that said re- <br />appraisals will not be considered a valid basis of negotiations <br />until and unless the proposed comprehensive plan land use <br />amendments are fully approved by the local governments and the <br />State. <br />Chief of Environmental Planning Roland DeBlois suggested it <br />might be appropriate for Mr. Bayer to speak since he had requested <br />to appear before them. <br />Charles Bayer, president of Lost Tree Village, stated his <br />purpose as outlined in his letter of January 27, 1997, as follows: <br />Lost Tree Village Corporation <br />January 27, 1997 <br />HAND DELIVERED <br />Mr. James E.
