the expenditure of funds for DEP permitting and looking for their <br />cooperation. <br />Director Wright indicated that the initial response from DEP <br />indicates that it will be possible to piggy -back on the current <br />permits. <br />Commissioner Adams expressed her irritation for the monitoring <br />costs for the PEP reef. She suggested that Commissioner Ginn <br />pursue with Congressman Weldon the reimbursement of the costs for <br />this matter because she felt it was the Federal government's <br />responsibility. <br />Commissioner Ginn indicated her willingness to do so. <br />Commissioner Adams also felt that all of the facts concerning <br />the ordnance have not been revealed. She wanted to be certain that <br />the Government will reimburse the County for the cleanup. <br />Commissioner Macht raised questions about liability and <br />responsibility, and County Attorney Vitunac responded that the <br />contracts contained "hold harmless" and "insurance requirement" <br />clauses. Also the County is protected by sovereign immunity over <br />$200,000 per accident. <br />Commissioner Adams asked about the responsibility for wrecks, <br />and County Attorney Vitunac counseled that in terms of law suits, <br />no one could be sued for a 75 -year old wreck. That is just the way <br />things are. <br />Discussion ensued about responsibility of a ship's owner for <br />present day wrecks. <br />Commissioner Tippin reiterated his concern about use of Road <br />and Bridge trucks, and Director Wright explained the plan was to <br />stage the removal of debris so it would not impact Road and Bridge <br />on a daily basis. <br />Commissioner Tippin suggested adding $5,000 to the contract <br />for the vendor's trucks to haul. He believed that using County <br />trucks would be a terrible expense to the rest of the county <br />because the Road and Bridge Division is short of manpower and <br />trucks to fulfill their work load. <br />Commissioner Adams asked if they should cap the expense at <br />$90,000 and found some agreement from other Board members. <br />Commissioner Ginn reasoned the need for the removal of the <br />debris and dismissed the concern for precedent setting based on <br />safety and the reasons for expediency. She confirmed that she <br />would seek reimbursement through Representative Weldon's office. <br />Chairman Eggert suggested that U.S. Senators Connie Mack and <br />Bob Graham also be contacted. <br />62 <br />February 4, 1997 <br />
