BOOK DO PACE 536 <br />County Attorney Charles Vitunac advised that this is an annual <br />procedure and makes our Code Book complete. <br />Chairman Eggert opened the public hearing and asked if anyone <br />wished to be heard on this matter. There being none, she closed <br />the public hearing. <br />ON MOTION by Commissioner Ginn, SECONDED by <br />Commissioner Adams, the Board unanimously adopted <br />Ordinance 97-4, codifying the ordinances of Indian <br />River County. <br />ORDINANCE 97- 04 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA, CODIFYING THE ORDINANCES <br />OF INDIAN RIVER COUNTY, FLORIDA. <br />WHEREAS, Section 125.68, F.S. requires the current codification of all <br />ordinances comprising the code; and <br />WHEREAS, this is to be done on an annual basis, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, that: <br />SECTION 1. CODIFICATION. <br />All ordinances which have been published in 'The Code of Indian River <br />County" up to and including Supplement No. 25 are hereby deemed to be <br />codified and said code shall be the best evidence of the laws of Indian River <br />County. <br />SECTION 2. SEVERABILITY. <br />If any section, or any sentence, paragraph, phrase, or word of this <br />ordinance is for any reason held to be unconstitutional, inoperative, or void, <br />such holding shall not affect the remaining portions of this ordinance, and it <br />shall be construed to have been the legislative intent to pass the ordinance <br />without such unconstitutional, invalid or inoperative part. <br />SECTION 3. EFFECTIVE DATE. <br />A certified copy of this ordinance, as enacted, shall be filed by the Clerk <br />with the Office of the Secretary of State of the state of Florida within ten days <br />after enactment, and this ordinance shall take effect upon filing with the <br />Secretary of State. <br />Approved and adopted by the Board of County Commissioners of Indian <br />River County, Florida, on this __Ijdayof F e h r i, a r v ,1997. <br />This ordinance was advertised in the Vero Beach Press -Journal on the <br />3 0 day of J a n u a r V , 1997, for a public hearing to be held on the -4.� day <br />FEBRUARY 11, 1997 26 <br />
