ALTERNATIVES AND ANALYSIS <br />In analyzing the application received, staff has coordinated with FDEP Bureau of Beaches <br />and Coastal Systems, conducted site visits and reviewed the application for completeness <br />and conformance with Florida Statutes. FDEP staff has indicated that the structures are <br />considered vulnerable and the applicant's two primary dwelling foundations would be <br />exposed as a result of a 15 -year return interval storm event. The applicants have proposed <br />meeting the five state requirements. <br />The Applicants Engineer will submit a letter addressing the above items. 'a -e' which will <br />be distributed at the 03/04/97 Board meeting. <br />County staff has contacted the City of Vero Beach for review. The City of Vero Beach has <br />suspended Chapter 75. Beach Maintenance & Preservation of the Vero Beach Code of <br />Ordinances and has no comments on the proposed construction. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends that a FS Chapter 161.085(3) Emergency Permit be issued for the Millar <br />and Somoza properties at this time subject to the following conditions: <br />1) Seaward of the wall, beach compatible sand is placed to reestablish the beach and <br />dune system. <br />2) The seawall be placed as landward as possible. A location along the top of the bluff <br />is recommended for both properties in accordance with the drawings(to be <br />submitted by Engineer.) The County will require that before the start of construct <br />activity authorized by this permit, a pre -construction conference will be held at the <br />site. among the contractor, the owner(s) or authorized agent, and a staff <br />representative from Indian River County Public Works. The owner(s) or an <br />authorized agent will notify the parties in writing 48 hours before the conference. <br />The proposed location of the structure will be staked out for the conference. <br />3) Any adverse impacts created by the seawall on adjacent properties are mitigated <br />by sand placement to be determined by staff. <br />4) All public access will be retained. <br />5) The construction will have minimum impact on native coastal vegetation and any <br />native vegetation removed or damaged will be replaced. No construction will occur <br />during the turtle nesting season (March 1 through October 31) unless allowed by <br />the USF&WS and FDEP. <br />6) The emergency seawall will be temporary and will be removed unless an FDEP <br />permit for a permanent seawall is acquired. <br />7) The applicant will provide emergency protection as soon after the initial erosion <br />event as practicable. Delay in providing protection more than 30 days from the <br />declaration of an emergency will result in finding of "no emergency" and emergency <br />protection will no longer be authorized. <br />8) If anytime during the construction activity authorized by this permit, a standard <br />permit is approved by the FDEP for the construction of a permanent structure, the <br />emergency permit will be nullified and the FDEP permit will supercede all previous <br />County approvals. Therefore, no work will be conducted under this permit and the <br />owner(s) or an authorized agent, must comply with the FDEP permit. The owner(s), <br />or an authorized agent will obtain any applicable license or permits which may be <br />required by Federal, State, County or Municipal law, also, the applicant must obtain <br />all easements and property rights required for the project.
