Banack, Jr.'s Request to Amend the <br />Comprehensive Plan to Redesignate Approximately 15.02 <br />acres from M-1 to C/I, and to Rezone that 15.02 acres <br />from A-1 to CG <br />PLAN AMENDMENT NMMER: LURA 96-07-0193 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of March 18, 1997. <br />DESCRIPTION AND CONDITIONS <br />This is a request to amend the Comprehensive Plan and rezone <br />approximately 15.02 acres, located at the northwest corner of the <br />intersection of 58th Avenue and the Main Relief Canal. <br />The request involves changing the land use designation from M-1, <br />Medium -Density Residential -1 (up to 8 units/acre), to C/I, <br />Commercial/Industrial Node, and rezoning the property from A-1, <br />Agricultural District (up to 1 unit/5 acres) to CG, General <br />Commercial District. The purpose of this request is to secure the <br />necessary land use designation and zoning to develop the property <br />with commercial uses. <br />On September 26, 1996, the Planning and Zoning Commission voted 4-1 <br />to recommend that the Board of County Commissioners transmit the <br />proposed land use amendment to the State Department of Community <br />Affairs (DCA) for their review. <br />On November 21, 1996, the <br />to transmit the proposed <br />their review. That objection <br />was procedural in nature and related to the county's state mandated <br />Evaluation and Appraisal Report (EAR). <br />According to state law, the county was required to submit an <br />adopted EAR to DCA by January 1, 1997. The county complied with <br />that requirement by adopting its EAR on December 17, 1996, and <br />transmitting it to DCA on December 20, 1996. Once a local <br />government's adopted EAR submittal date has passed, state law <br />prohibits that local government from amending its comprehensive <br />plan until DCA has determined that the EAR is sufficient.
