PUBLIC DISCUSSION ITEM - TERRY CUMAIINGS' REQUEST <br />CLEANUP OF TRASH AT 3890 41ST STREET <br />The Board reviewed a Memorandum of March 19, 1997: <br />TO: James Chandler <br />County Administrator <br />FROM: Robert M. Keating, AICP ,4kl <br />Community Development Director <br />DATE: March 19,1997 <br />SUBJECT: Jerry Cummings' Request For County Assistance In <br />Clean -Up Of Trash At 3890 41st Street <br />It is requested that the information herein presented be given formal consideration by the <br />Board of County Commissioners at its regular meeting of March 25, 1997. <br />Recently, Mr. Jerry Cummings approached county staff and requested assistance in removing <br />junk and debris from property that he owns. It is Mr. Cummings' position that the junk and <br />debris was discarded by others and, for that reason, the County should assist in removing the <br />junk and debris. Specifically, Mr. Cummings is requesting that the County provide a <br />dumpster; remove the dumpster and transport it to the landfill after Mr. Cummings has filled <br />it, and waive disposal fees. <br />Located at 3890 41st Street, the subject property was purchased by Mr. Cummings three <br />years ago. According to Mr. Cummings, the approximately 12'x 50' area having household <br />trash and debris existed when he bought the property. In fact, Mr.. Cummings has indicated <br />that in the past he tried to get the County to remove the debris. Code enforcement staff, <br />however, have found no record of complaints having been filed on the subject property. <br />Since he bought the property, Mr. Cummings has fenced and posted it to deter trespassing <br />and further dumping. <br />Besides the junk and debris, the property also contains a run-down building. In response to <br />a sheriffs office complaint, the building division recently issued a condemnation notice for <br />the building. Mr. Cummings then boarded up the building to address the unsafe building <br />condition. <br />ANALYSIS: <br />Mr. Cummings' position is that he did not discard the junk and debris on his property and <br />therefore should not have to pay for its removal. He has further indicated that removing the <br />junk and debris will enhance the appearance of the County and benefit the public. He also <br />has said that, by fencing the property as he has done, no further dumping will occur on the <br />property. <br />23 <br />March 25 1997 BOOK IUJ9 <br />
