Chandler <br />County Administrator <br />Community Developmefit r4*ector <br />THROUG33: Sasan Rchani, AICP �, <br />Chief, Long -Range Planning <br />FROM: John Wachte� <br />Senior Planner, Long -Range Planning <br />DATE: March 19, 1997 <br />RE: COUNTY =TIATED REQUEST TO REZONE APPROXIMATELY 111 <br />ACRES FROM RM -6 TO CON -1 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of April 1, 1997. <br />DESCRIPTION AND CONDITIONS <br />This is a county initiated request to rezone approximately 111 <br />acres from RM -6, Multiple -Family Residential District (up to 6 <br />units/acre), to Con -1, Public Lands Conservation District (zero <br />density). <br />The subject property, located at the northwest corner of 58th <br />Avenue and CR 510, is generally known as the Wabasso Scrub <br />Conservation Area. On October 2, 1995, Indian River County <br />purchased the subject property. Funding for that purchase was <br />provided through the county's environmental lands acquisition <br />program and a 50% cost -share grant from the State of Florida <br />(through the Florida Communities Trust). <br />In conjunction with purchasing the property, the Board of County <br />Commissioners adopted a management plan for this environmentally <br />important site. That plan calls for the land to be used for <br />resource management and passive/non-consumptive recreation. <br />Furthermore, that plan states that the county will initiate a land <br />use amendment and rezoning request to designate the property as <br />conservation land. The land use amendment portion of that <br />commitment was completed when the Board adopted the C-1, Publicly <br />Owned Conservation -1 (zero density) land use designation for the <br />subject property on March 18, 1997. <br />The purpose of this request, in addition to meeting the management <br />plan's rezoning commitment, is to secure the necessary zoning to <br />ensure that the subject property's environmental significance will <br />be preserved, and that the future use of the site will be <br />consistent with the site's management plan. <br />Rezoninv Procedures <br />When initiated, this application involved both a land use amendment <br />and a rezoning request. As with most such applications, both <br />requests were processed concurrently. State law, however, provides <br />some special requirements for county initiated rezoning requests, <br />such as the subject request, that involve more than 10 acres. <br />Among those special requirements are the following: <br />• The Board must hold 2 advertised public hearings. <br />• The second hearing must be held at least 10 days after the <br />first hearing and must be advertised at least 5 days prior to <br />the bearing. <br />The first rezoning public hearing was held at -the March 18, 1997 <br />Board of County Commissioners meeting. At that meeting, the Board <br />voted 5-0 to hold the second rezoning public hearing at the April <br />1, 1997 Board of County Commissioners meeting. Because that <br />meeting meets the requirements for the second hearing, the rezoning <br />ordinance can be adopted following that public hearing. <br />On September 26, 1996, the Planning and Zoning Commission voted 6-0 <br />tb recommend that the Board of County Commissioners approve this <br />request. <br />APRIL 19 1997 36 <br />
