BOOM 01 PAGE 46 <br />RECOMMENDATION <br />Based on the analysis, staff and the Planning and Zoning Commission <br />recommend that the Board of County Commissioners approve this <br />request to rezone the subject property to Con -1. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, she closed <br />the public hearing. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Macht, the Board unanimously adopted <br />Ordinance 97-014 amending the Zoning Ordinance and <br />the accompanying Zoning Map from RM -6 to CON -1 for <br />the property located at the Northwest corner of 58th <br />Avenue and C.R. 510 and described herein and <br />providing for effective date. <br />ORDINANCE NO. '97-14 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM RM -6, <br />TO CON -1, FOR THE PROPERTY LOCATED AT THE NORTHWEST CORNER OF <br />58TH AVENUE AND C.R. 510, AND DESCRIBED HEREIN, AND PROVIDING <br />FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that <br />this rezoning is in conformance with the Comprehensive Plan of <br />Indian River County; and <br />WHEREAS, the Board of County Commissioners has held two public <br />hearings pursuant to this rezoning request, at which parties in <br />interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />PARCEL 1: <br />THE NORTHWEST 1/4 OF THE SOUTHEAST 1/4 OF SECTION 29, TOWNSHIP <br />31 SOUTH, RANGE 39 EAST, INDIAN RIVER COUNTY, FLORIDA; <br />PARCEL 2: <br />THE SOUTHWEST 1/4 OF THE SOUTHEAST 1/4, LESS THE WEST 10 <br />ACRES, IN SECTION 29, TOWNSHIP 31 SOUTH, RANGE 39 EAST, INDIAN <br />RIVER COUNTY, FLORIDA; <br />"RM 1, 1997 40 <br />� ® i <br />
