Hill 2410 must be passed she aaid. . <br />Public Works Director Jim Davis advised that if the Murphy Act <br />revisions pass, all Murphy Act rights-of-way will expire 7/1/97. <br />Some of this right-of-way has structures in it and if all rights- <br />of-way are abandoned, the County will need to acquire monumental <br />amounts of right-of-way. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Ginn, the Board unanimously adopted <br />Resolution 97-32 to the Legislature of the State of <br />Florida in favor of retaining The Murphy Act. <br />RESOLUTION NO. 97-32 <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, TO <br />THE LEGISLATURE OF THE STATE OF FLORIDA IN <br />FAVOR OF RETAINING THE MURPHY ACT. <br />WHEREAS, Senate and House Bills have been filed with the Legislature of the <br />State of Florida, which would in fact repeal the Murphy Act, which has been in effect since <br />1937; and <br />WHEREAS, the right of way protected by the Murphy Act has enabled Florida <br />counties and cities to construct and improve better and safer roadways for the protection <br />of all of the residents of Florida, and, if local governments can no longer rely on Murphy <br />Act rights of way and must instead purchase the same rights of way, the ability of local <br />governments to provide safe roadways will be severely impaired; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that Indian River County <br />respectfully requests that the Legislature of the State of Florida retain the Murphy Act as it <br />has been for the last 60 years. <br />The resolution was moved for adoption by Commissioner Macht, and the motion <br />was seconded by Commissioner Ginn, and, upon being put to a vote, the vote was as <br />follows: <br />Chairman Carolyn K.
