BOOK 1-01 PAGE 22 <br />Park Subdivision. Those service -of -notice attempts failed; however, <br />in accordance with County Code Section 973.09, the subject property <br />was posted (on January 15, 1997) to serve as legal notice. The <br />Respondent was cited as maintaining his property in violation of <br />County Code Sections 973.03(1) and 973.03(2), which prohibit the <br />accumulation of overgrown weeds (over 18 inches in height), trash <br />and debris on residential property. <br />The respondent failed to mow the overgrown weeds and remove the <br />trash and debris within a specified 30 day time period: Therefore, <br />in accordance with Chapter 973.04(2) of the County Code, county <br />personnel (ie: Road and Bridge Division staff) abated the nuisance <br />violation, with the cost to be assessed against the property owner. <br />Chapter 973.06(1) of the County Code requires that the cost of a <br />county nuisance abatement shall be calculated and reported to the <br />Board which, by resolution, shall assess such costs_ against the <br />property. This matter is presented herein to the Board for <br />consideration to adopt said resolution. <br />ALTERNATIVES AND ANALYSIS: <br />Section 973.06 of the County Public Nuisance Ordinance specifically <br />reads as follows: <br />"After abatement of nuisance by the county, the cost thereof to the county <br />as to each lot, parcel or tract of land shall be calculated and reported <br />to the board of county commissioners. Thereupon, the board of county <br />commissioners, by resolution, shall assess such costs against such lot, <br />parcel or tract of land. Such resolution shall describe the land and <br />state the cost of abatement, which shall include an administrative cost of <br />seventy-five dollars ($75.00) per lot. Such assessment shall be a legal, <br />valid and binding -obligation upon the property against which made until <br />paid. The assessment shall be due and payable thirty (30) days after the <br />mailing of the notice of assessment after which interest shall accrue at <br />the rate of twelve (12) per cent per annum on any unpaid portion thereof." <br />Costs for equipment use, labor, and land fill charges, as indicated <br />by the Road and Bridge Division (see attached), plus the $75.00 <br />administrative fee calculates to be: <br />Equipment: 148.16 <br />Labor: 280.64 <br />Landfill Charges: 60.30 <br />Administrative fee: 75.00 <br />TOTAL: $564.10 <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners adopt the <br />attached resolution assessing $564.10 in abatement costs, in <br />accordance with Chapter 973.06, Public Nuisance, of the Code of <br />Laws and Ordinances of Indian River County. <br />Commissioner Adams had concern about the hourly rate specified for the County's truck, and <br />Public Works Director Tun Davis explained that the truck has a boom to pick up trash and the hourly <br />rate was comparable to commercial rates. <br />42 <br />April 22, 1997 <br />M s M <br />
