Lewis Barton (Ed Papin Residence) 2025 Surfside Terrace <br />Dear Mrs. Trindell: <br />Per our phone conversation on April 30, 1997, three (3) applicants with active <br />emergency permits have been sent notices to stop all construction activity seaward of <br />the dune crest on May 1, 1997 (see attached letter). The location of the residences is <br />shown on the enclosed figure. All three (3) projects are incomplete and the County <br />anticipates that the applicants will be requesting a time extension, of their "emergency <br />permits", to work well into the turtle nesting season. <br />The County has obtained signed agreements from all of the applicants and their <br />contractor which allowed them to continue work from March 1, 1997 through May 1, 1997. <br />These agreements enforced the "mark & avoid" technique to ensure compliance with <br />statutes and rules for marine turtle protection (see enclosed agreement). <br />The County respectfully requests prompt assistance from the Bureau of Protected <br />Species Management in identifying those projects, if any, that can continue work into <br />turtle nesting season. Davis, Public Works Director <br />Roland Deblois, Chief Environmental Enforcement <br />Gene Chalecki, Engineering Supervisor, FDEP <br />Director Davis explained that May 1st was the deadline for ceasing work because of <br />the turtle season along the coastline. However, the homeowners want to use the Park until <br />June 1 5'. Staff has received a letter from DEP who passed the buck to Fish & Wildlife. Staff <br />would not be comfortable with allowing them to continue to use the Park after May 1S, <br />unless a $10,000 bond is posted and Fish & Wildlife would sanction the work continuing <br />after May I". <br />MAY 6 97 76 <br />
