Keating, AICP hu iC <br />Community Development Director <br />DATE: June 11, 1997 <br />SUBJECT: CONSIDERATION OF ALLOWING PLACEMENT OF BUS <br />BENCHES WITH ADVERTISEMENTS IN ROAD <br />RIGHTS-OF-WAY <br />It is requested that the information provided herein be given formal consideration by the <br />Board of County Commissioners at its regular meeting of June 17, 1997. <br />DESCRIPTION & CONDITIONS• <br />Recently, Treasure Coast Bench Advertising, Inc., representing the Vero Beach Jaycees, the <br />Sebastian Lions Club, and the Fellsmere Lions Club, contacted county staff with a proposal. <br />The proposal was that the referenced service clubs would provide bus benches throughout <br />the County at no cost to the County, if advertising were allowed to be placed on the benches. <br />As proposed, benches would be placed at established stops for both the Community Coach <br />bus system and the Indian River County School Board bus system. These benches would <br />be located within road rights -of way, but meet all applicable safety requirements. Any <br />county action on this matter would affect only the unincorporated area, with separate action <br />required by municipalities to allow benches within their jurisdictions. <br />According to representatives of Treasure Coast Bench Advertising, Inc., the County would <br />benefit by having benches placed at bus stops at no cost to the County. Similarly, the service <br />clubs would benefit by receiving advertising revenue, funds that would then be used for the <br />clubs' charitable activities. <br />Along with the bus bench proposal, the service clubs and Treasure Coast Bench Advertising, <br />Inc. provided county staff with a draft legal agreement. A copy is attached. As structured, <br />the legal agreement would be entered into by the service clubs as sponsors of the bus bench <br />project and Indian River County. The agreement designates Treasure Coast Bench <br />Advertising, Inc. as the Service Company. <br />Incorporated within the proposed legal agreement are the rights and responsibilities of each <br />of the parties - the County, the service clubs, and the Service Company. According to the <br />proposed agreement, Treasure Coast Bench Advertising, as the Service Company, would <br />install bus benches with advertising on them throughout the County. The benches would <br />be owned and maintained by the Service Company, and could be placed in public rights-of- <br />way only if locational standards specified in the agreement were met. As proposed, the <br />agreement would remain in effect for twelve years with an automatic twelve year renewal, <br />during which time the Service Company would maintain liability insurance and indemnify <br />the County against all claims. <br />JUNE 179 1997 <br />
